A previous proposal to
build an off-the-grid dwelling led to a denied NOI for a wood bridge. An appeal to the DEP
resulted in a design revision to a steel bridge, meeting Wetlands Protection Act standards.
However, the judiciary required reapplication with the steel bridge design. Subsequent ZBA
variances for a wood or steel bridge were denied, leading to a regulatory taking lawsuit, which
the court partly dismissed. The applicant appealed, resulting in a directive to first consult the
Conservation Commission. The applicant proposed the town purchase the island under agreeable
terms, and the town agreed. A meeting is scheduled with CPC to discuss funding, with a
suggestion that the Conservation Department applies to CPC for the purchase.
PRE/POST AGENDA
• Presentation: Cape Cod Commission, Heather McElroy & Michelle White: Climate
Change
■ Background:
■ 19% of Cape Cod is in a flood zone.
■ Property values in flood zones assessed in the billions.
1
