MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> OCTOBER 9, 2024 <br /> Mr.Furbush wants clarification regarding the private way, and the comment from the abutter letter <br /> regarding ownership of the road. Mr. Furbush agrees that this is not a zoning issue, but would like <br /> these comments addressed at the next meeting. <br /> Attorney Kirrane will address the Board's concerns at the next meeting are the following; a revised <br /> plan of the average existing grade, and will discuss with the Building Commissioner regarding lot <br /> coverage,the 50%coverage for the floor and whether it is considered a story above grade,revising <br /> the lot area and lot coverage with the State's statute and bylaw of the inland bank. He will reach <br /> out to the Board of Health regarding the fourth bedroom, and also the Ground Water Protection <br /> bylaw, and will discuss with the Sewer Commissioner. He will also reach out for comments from <br /> the Fire Department regarding access on the road. <br /> Attorney Kirrane asked if the Board agrees that a gravel driveway is considered pervious. The <br /> Board agreed that a gravel driveway is considered pervious. Chairman Bonvie had several <br /> conversations with engineers, and they all agree that gravel is pervious. <br /> Attorney Kirrane mentioned that the new home is modular construction, and will be constructed <br /> in one day. He will also discuss with the Builder the number of trees that will be removed. There <br /> was a comment regarding the lot not being buildable. This is not true. There is an existing house <br /> on the lot, and it is considered a buildable lot. He will provide the Board with clarification on the <br /> deed. It's an R-3 Zoning District and year-round houses are allowed. <br /> Chairman Bonvie asked for comments from the abutters. The abutter that resides at 6 Ned Besse <br /> Road spoke in opposition of the proposed dwelling. He had concerns regarding permitting. The <br /> abutter from 26 Melissa Avenue spoke in opposition of the new dwelling. He discussed his <br /> concerns with the road, and mentioned his engineer will be re-staking the road. He had a map that <br /> he believes is more accurate than the proposed survey of the lot. <br /> Chairman Bonvie asked Mr. Daniels for the documents and more information that he owns Ned <br /> Besse Road. <br /> Ms. Sangeleer mentioned that a house was razed and replaced on Melissa Avenue back in 2020, <br /> and there were no abutter concerns with that project. Mr. Daniels said that he was not opposed to <br /> that project and is a friend of the owner. <br /> Ms. Arlene Wilson is working with Mr. Daniels and had concerns with the site plan and the <br /> wetlands information depicted on the plan.
