Wolpe <br /> requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> construction of two additions, and a detached pool cabana on property located in an R-3 Zoning <br /> District, Map 100, Parcel 5,Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on April 26, 2024 and May 3, 2024 copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> A public hearings was held on the Petition at the Mashpee Town Hall on Wednesday, May 22, <br /> 2024, and was continued until to July 10, 2024 to afford the attorney five (5) voting Board <br /> members. <br /> On July 10, 2024, a public hearing was held at which time the following members of the Board of <br /> Appeals were present and acting throughout; Chairman, Ronald Bonvie, Board Members, Sharon <br /> Sangeleer, William A. Blaisdell, Jonathan Furbush, and Associate Member, George <br /> Ganzenmuller. <br /> Attorney Christopher Kirrane represented the homeowners requesting a Written Finding under <br /> §174-17 and§174-33 (setback from wetlands),to remove a portion of an existing deck and replace <br /> it with a first floor mud room on an existing foundation with new sono tubes, a new entry landing <br /> and steps.There is a portion of an existing first floor bump out that will be replaced with additional <br /> living space. The homeowners also proposed to construct a 16 ft.x 16 ft.pool cabana. The existing <br /> dwelling is 35.6 ft. to the front yard setback from Punkhom Point Road, and fails to meet the <br /> required 40 ft., and is located within the flood zone. <br /> 1 <br />
