6. The Trustee owns property with an address of 0 Punkhorn Point Road in Mashpee <br /> consisting of Salt Marsh. <br /> 7. Directly abutting the Trustee's property on the west is the subject property at 84 Punkhom <br /> Point Road, Mashpee("Property"). <br /> 8. The Property has an area of approximately 60,855 square feet and is improved with a <br /> House, Garage and Pool that is about 4,664 square feet in size. <br /> 9. The Property is situated in the R-3 Residential Zoning District. <br /> 10. Located on and adjacent to the Property are several wetlands resources including salt <br /> marsh, coastal banl<, and land subject to coastal storm flowage. <br /> 11. The Property is also located within flood zones and velocity zones (AE and VE). <br /> 12. Pursuant to § 174-3)I of the Mashpee Zoning Bylaw, wetlands as defined by the <br /> Massachusetts Wetlands Protection Act(G.L. c. 131,)1, § 40) are excluded from Lot Area <br /> and Lot Coverage calculations. <br /> 13. As a result, for zoning compliance purposes,the lot has an area of only 19,559 square <br /> feet. <br /> 14. On or about March 11, 1999 the Petitioner predecessor in title John C. and Sandra S. <br /> Hessler filed an application with the Board requesting a Variance from Section 174-32 of <br /> the Zoning By-laws for permission to construct a new single-family home on an unpaved <br /> road at the property <br /> 15. Section 174-3)2 of the Mashpee Zoning Bylaw provides as follows: <br /> To ensure that all buildings shall be accessible to Fire Department apparatus by way of access <br /> roadways capable of supporting firefighting apparatus with an all-weather surface roadway,there <br /> shall be an unobstructed,paved access roadway of not less than twenty(20')feet with a vertical <br /> clearance of not less than thirteen (IT)feet six(6")inches with all comers having a minimum <br /> inside radius of not less than twenty-eight(28')feet and a ininirnU111 outside radius of not less than <br /> forty-six(46')feet. Said access roadway shall be constructed to a point not less than one hundred <br /> fit, (150')feet from the furthest point of any building on the lot.Where there is a lot with only a <br /> one-family dwelling and/or a residential accessory building,such access,where it lies within the <br /> 3 <br />
