On the ANR plan under the Mashpee Planning Board endorsement the plan states: "No <br /> determination as to compliance with zoning requirements has been made or intended by <br /> this endorsement under MGL chapter 41, Section 81L." <br /> 25. Parcel `B"is a wetlands being land subject to coastal storm flowage and Pursuant to <br /> §174-31 of the Mashpee Zoning Bylaw, wetlands as defined by the Massachusetts <br /> Wetlands Protection Act (G.L. c. 131, § 40) is excluded from Lot Area and Lot Coverage <br /> calculations. <br /> 26. Parcel "A"is not a wetlands as defined by the Massachusetts Wetlands Protection Act <br /> (G.L. c. 131, § 40) <br /> 27. On September 21, 2021 James C.Atkins and John J. Weltman deeded the Petitioner land <br /> Shown as Parcel"B"on the ANR plan containing approximately 2,201 square feet of <br /> wetlands. The deed was recorded with the Barnstable County Registry of Deeds in Book <br /> 34494, Page 166. <br /> 28. On September 21, 2021 The Petitioner deeded James C.Atkins and John J. Weltman land <br /> Shown as Parcel"A" on the ANR plan containing approximately 2,201 square feet of <br /> land. The deed was recorded with the Barnstable County Registry of Deeds in Book <br /> 34494, Page 168. <br /> 29. As a result of their voluntary deed the Petitioner reduced their lot area and increased their <br /> nonconformity. <br /> 30. Section 174-9 of the Mashpee Zoning Bylaw provides as follows: <br /> No buildings shall be erected or used and no land shall be used or divided unless in conformity <br /> with the regulations of this chapter.All other buildings and all other uses of land or of buildings <br /> 5 <br />
