MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner, Bryan W. Anderson <br /> 37 Amy Brown Road, Map 109 Parcel 4 <br /> Mashpee, MA 02649 <br /> SP-2024-23 <br /> SPECIAL PERMIT FINDINGS <br /> The subject property located at 37 Amy Brown Road consists of 30,955 sq. ft. of total lot area. The <br /> dimensional requirements located in the R-3 Zoning District are as follows: <br /> Minimum Lot Frontage— 150 ft. <br /> Front yard setback—40 ft. <br /> Rear yard setback— 15 ft. <br /> Side yard setback— 15 ft. <br /> Maximum lot coverage—20% <br /> Maximum height—35 ft. <br /> The Conservation Department comments dated August 12, 2024 were read into the record; <br /> "Resource Areas:Buffer zone to Salt Marsh, buffer zone to Bordering Vegetated Wetlands (BVW), <br /> buffer zone to Coastal Bank, & Area of Critical Ecological Concern (ACEC). Notice of Intent <br /> (NOI)permit application was approved with a 4-1 vote. Raze &replace of existing structure with <br /> additions and rebuild of existing dock was approved due to increased mitigation, reduction in <br /> access path width,planting of five native trees, and updating the dock/pier/float system will create <br /> better conditions for the ACEC. " <br /> The Board of Health comments dated August 14, 2024 were read into the record; "Septic Design <br /> is for 4 bedrooms. " <br /> The Board made the following findings: <br /> • The dwelling reconstruction will be building code compliant. <br /> • A new I/A septic system is proposed. <br /> • Drywells will be installed to capture all water runoff. <br /> • The project was approved by the Conservation Commission. <br /> • There are no new nonconformities being created. <br /> • The new construction will comply with current day zoning requirements and is consistent <br /> with other redevelopment in the neighborhood. <br /> • All construction of the dwelling is outside of Land Subject To Coastal Storm Flowage <br /> (LSTCSF). <br /> 2 <br />
