MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner,Joan F. Flanagan <br /> 58 Bearse Road, Map 117 Parcel 32 <br /> Mashpee, MA 02649 <br /> SP-2024-26 <br /> The non-conformities to the side yard setbacks will be improved from 12.7 ft.to 12 ft. on the south <br /> side, and 10.5 ft. to 13 ft. on the north side. There are no new non-conformities being created. <br /> There will be no intensification of those setbacks. The total lot coverage will be 23.6% which is <br /> under the 25%requirement. <br /> There will be drywells installed. The shed is being eliminated. There is a proposed I/A septic <br /> system, and this project was approved by the Conservation Commission. The actual structure <br /> coverage increase is less than 130 sq. ft. even though the lot coverage is increasing from 69% to <br /> 77.7%. There are no new non-conformities being created. There will be sufficient parking as may <br /> be required, and this proposed project is not any more detrimental to the neighborhood than what <br /> currently exists. <br /> GENERAL FINDINGS <br /> The subject property located at 58 Bearse Road has 6,000 sq.ft.of land.The minimum dimensional <br /> requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 sq. ft. <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet <br /> There were no abutters present. <br /> The Board of Health comments dated June 10, 2024 were read into the record; "House to remain <br /> 3 bedroom. IM will be installed,permit must be pulled with Health Department. " <br /> The Conservation Department comments dated June 6, 2024 were read into the record; "Resource <br /> Areas: Land Subject to Coastal Storm Flowage (LSCSF)NDI application for raze and replace of <br /> existing dwelling with installation of IA septic system, pervious driveway, drywells, hardscape, <br /> and associated appurtenances. Application received approval at the April 18`h hearing date with <br /> a vote of 4:1. " <br /> There were no more comments from the Board. <br /> 2 <br />
