Town of Mashpee <br /> Ij <br /> w , r. s 16 Great Neck Road North <br /> m <br /> Mashpee, MA 02649 <br /> zmwwv� , <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2024-27 <br /> Owner, 61 Shoestring Bay Road, LLC Bk.: 34382 <br /> 61 Shoestring Bay Road pg.: 200 <br /> Map 84,Parcel 35 <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 14, 2024 by Owner, 61 Shoestring Bay Road, LLC requesting a <br /> Variance under§174-31 fn. 1,and §174-33 (Setback 50 ft. from the nearest wetland resource area) <br /> to construct a new single family dwelling on the vacant lot located in an R-3 Zoning District, Map <br /> 84, Parcel 35, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on May 10, 2024 and May 17, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,June 12,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush,and Scott Goldstein. <br /> Attorney Christopher Kirrane represented the applicant for 61 Shoestring Bay Road. This lot is <br /> located in the Willowbend Development, and is part of an approved plan back in the late 1990's. <br /> This lot abuts a coastal bank that would require a Variance setback of 50 ft. from the wetland <br /> resource area. The site has a significant slope from the front to the rear of the property, and could <br /> be considered a topographical hardship. This is a vacant lot; there are no other variance requests, <br /> and the project was approved by the Conservation Commission. <br /> VARIANCE FINDINGS <br /> The Board reviewed the site plan and determined that the lot has a significant topographical slope. <br /> The Board of Health comments were read into the record; "Property is on Private Sewer, " <br /> 1 <br />
