MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owner of Record: Pamela M. Gangemi, Trustee of <br /> The 81 Echo Road Realty Trust <br /> Petitioner, White Oak Holdings, LLC <br /> 77 Echo Road, Map 19, Parcel 3,Ext.4 <br /> Mashpee, MA 02649 <br /> SP-2024-29 <br /> Chairman Bonvie addressed the Board stating that the final revisions were discussed among the <br /> applicants,Mr.Pesce,and Mr.Rivera,with Cape&Islands Engineering. The site plan was revised <br /> in accordance to the recommendations provided by Mr. Pesce. <br /> SPECIAL PERMIT CRITERIA <br /> §174-24 (C) (2): A Special Permit may be issued only following the procedures specified by the <br /> General Laws and may be approved only if it is determined that the proposed use or development <br /> is consistent with applicable state and town regulations, statutes, bylaws and plans, will not <br /> adversely affect public health or safety, will not cause excessive demand on community facilities, <br /> will not significantly decrease surface or groundwater quality or air quality, will not have a <br /> significant adverse impact on wildlife habitat, estuarine systems, traffic flow, traffic safety, <br /> waterways, fisheries, public lands or neighboring properties, will not cause excessive levels of <br /> noise, vibrations, electrical disturbance, radioactivity or glare, will not destroy or disrupt any <br /> species listed as rare, endangered or threatened by the Massachusetts Natural Heritage Program <br /> or any known historic or archaeologic site, will not produce amounts of trash, refuse or debris in <br /> excess of the town's landfill and waste disposal capacities, will properly dispose of stumps, <br /> construction debris, hazardous materials and other waste, will provide adequate off-street <br /> parking, will not cause excessive erosion or cause increased runoff onto neighboring properties <br /> or into any natural river, stream,pond or water body and will not otherwise be detrimental to the <br /> town or the area. <br /> §174-25(G)(13): Contractor Yard. Storage, PODS and the like are not permitted. History:Added <br /> 10-19-2009 ATM Article 14, approved by Attorney General 1- 26-2010. (Requires a Special <br /> Permit). <br /> SPECIAL PERMIT FINDINGS <br /> • The applicant provided a list of equipment they employ for their business. The equipment <br /> consists of four (4)pickup trucks, two (2)box truck size vehicles, one (1) skid steer,three <br /> (3)wood chippers that are hinged to trucks, and five (5)trailers. <br /> • The Stormwater and O&M calculations were revised and accepted by Pesce Engineering <br /> and is part of this Decision as (Exhibit A). <br /> • Pesce Engineering provided his final report dated July 8, 2024, and is part of this Decision <br /> as (Exhibit B). <br /> 2 <br />
