MA HPEE ZONING BOARD of APPEALS <br /> MEETING MINUTE <br /> DECEMBER 14,2022 <br /> 3. The Board issues a variance under§174-33 setback from the water/ wetlands in the amount <br /> of: 50 ft. <br /> 4. Conditioned on all Town Department comments read into the record. <br /> Mr. Gould seconded. All were in favor of the variance for the stairway project. <br /> 2 Sunset Circle: owners, Wayne P. Pacheco and Leanne J. Fitzgerald request a Written Finding <br /> under 174-17 of the Zoning Bylaws to allow for an extension, alteration to a pre-existing <br /> nonconforming existing garage and dwelling on property located in an R.-5 Zoning District, Map <br /> 64 parcel I. Mashpee, MA. <br /> Sitting on this hearing are the three regular Board members, Mr. Caggiano, and Mr. Reidy. <br /> Attorney Christopher Kirrane represented the application for a written Finding. Also present was <br /> Raul Lizardi-Rivera, with Cape & Islands Engineering, and Al Mendelson, General Contractor. <br /> This project is located in the Johns Fond neighborhood. The current structure is non-conforming <br /> in one aspects it is only 2 9.8 ft. off of Sunset Circle. <br /> There proposed alterations consist of an extension of a deck,the existing garage will be expanded <br /> from a one-car to a two-car garage, and there will be a second story over the garage. There are no <br /> new non-conformities being created. Mr. I irrane said the addition will be moved further back <br /> from the front setback. The deck will not be extending into the 5 o ft. setback,and will not encroach <br /> on the rear setback. The side yard will remain conforming. <br /> Mr. Reidy read the Board of Health comments into the record, "spore with builders family room <br /> will have a closed cased opening to kitchen, but a new opening will have a cased opening voiding <br /> it from definition of bedroom."The Conservation Department comments were read into the record-, <br /> "this project was approved by the Commission at their Dec. 81h meeting with conditions of <br /> relocating a portion of mitigation closer to the shoreline of Johns Pond." <br /> Attorney Iirrane said that the architectural building plans were revised per the Board of Health <br /> comments. <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein made a motion that the Board approve the written Finding request for 2 Sunset <br /> Circle with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a written Finding <br /> under Mass General Law 40A Section 6. <br /> 4 <br />
