Reilly requests a Special Permit under §174-
17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, nonconforming
single-family residential structure and replace it with a new single-family
residential structure with an attached garage on property located in an R-3
Zoning District, Map 114, Parcel 93, Mashpee, MA. (Continued from the
October 9, 2024 hearings at the request of the Board).
Mr. Reilly requested representation from Attorney Christopher Kirrane. Mr. Reilly
submitted a proposal to raze and replace a single-family dwelling under Sections
174-17.1 and 174-33 (setback to wetlands). Also present was Mr. Tom Bunker
with BSS Design, Mr. Roger Brooks and Mr. Joao Junqueira with Cape Wide
Construction, Mr. Steve Cook, with Cotuit Bay Design, and Mr. Reilly, the
homeowner.
At the last meeting on October 9, 2024, there were some concerns raised by the
Building Commissioner and the Board regarding the initial proposal. Mr. Morris
believed that the applicant's intentions was to build a garage to store his boat,
and construct a one bedroom accessory apartment above the garage that will
become rental property which is not allowed under the zoning bylaw §174-25 I
(1). The Board agreed with the Building Commissioner. They also heard abutter
concerns with the size of the dwelling and garage.
I
