<br />Sitting on this particular hearing are Board Members, Jonathan Furbush, Bill Blaisdell, Ron
<br />Bonvie, Judith Horton, and Associate Member, Dom DeBarros.
<br />
<br />Mr. Steven Cook, owner of Cotuit Bay and Design, introduced himself to the Board and is
<br />representing the petitioner. Mr. Reardon, homeowner was also present. Mr. Cook stated he is
<br />proposing to convert an existing storage area within 11. 7 feet of the rear property line to
<br />expand the kitchen. The rear property line setback will move from 12.7 feet to 11.7 feet. The
<br />existing deck will be rebuilt in the same foot print and the lot coverage will be reduced from
<br />20.5% down to 20.4%. The architectural plans will match as exists and will not be more
<br />detrimental to the neighborhood. He stated they received approval from Board of Health and
<br />the Conservation Commission because it is an elevation 12 flood zone. The existing storage
<br />shed will be rebuilt to the same foot print and the rinse station will be removed.

<br />Bill Blaisdell read a memo from the Board of Health, dated June 25, 2013, “Michael W.
<br />Reardon and Claire M. Reardon in Zone II, plans submitted and approved for a three bedroom
<br />dwelling.”

<br />Mr. Bonvie made a motion that the Board approve a Written Finding under §174-17 of the
<br />Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration
<br />of a pre-existing, non-conforming structure to allow for construction of a new addition on
<br />property located in an R-3 Zoning District at 36 Nick Trail (Map 117 Parcel 299), Mashpee,
<br />MA. Also referencing three plans, site plan prepared for Michael Reardon of 36 Nick Trail,
<br />Mashpee, MA, prepared by J.E. Landers-Cauley, P.E. Civil Environmental Engineering, PO
<br />Box 364 West Falmouth, MA, scale 1” = 10’, Job No. 2249, revision 05/09/13, sheet one of
<br />three, dated 4/17/13 drawn by JDR. Referencing the existing shed will be removed and the
<br />insulation of the septic tank and pump chamber will be reinstalled to the existing location. The
<br />variance request is to the Board of Health.

<br />Also, referencing the plan entitled “Addition & Remodeling for Reardon Residence, 36 Nick
<br />Trail, and Mashpee, MA, prepared by Cotuit Bay Design, LLC, and 43 Brewster Road,
<br />Mashpee, MA 02649. Scale ¼” = 1”, dated 5/28/2013. Drawing No. A1 and A2.

<br />The Board also finds the proposal is not substantially more detrimental than the existing non-
<br />conforming structure. The new dwelling will be an improvement and will conform to current
<br />building code requirements and comparable in size and character to other structures in the
<br />neighborhood and has sufficient parking and setbacks as maybe required.
<br />
<br />Bill Blaisdell seconded the motion, yes, Votes: Mr. Furbush, yes, Mr. Bonvie, yes, Ms.
<br />Horton, yes, Mr. DeBarros, yes, All were in favor.
