(Map 112 Parcel 83) <br /> Mashpee, MA 02649 <br /> FINDING-2016-20 <br /> Chairman Furbush read the homeowner letter into the record dated 3/28/16. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, May 11, 2016, the Zoning Board of Appeals voted unanimously to issue a <br /> Written Finding to raze and replace a garage and are conditioned upon the following; <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6.Based on a plan titled; <br /> Applicant: Jane H. Comments submitted by Board of Health dated 5/11/2016: "Allowed as long as <br /> space remains unheated. The revised Title V design plan has been received and <br /> approved by the Board of Health. The approval was conditioned with the <br /> requirement to provide a deed restriction limiting the property to three <br /> bedrooms and the garage/studio structure shall remain unheated. The deed <br /> restriction shall be recorded and submitted to the BOH prior to issuance of the <br /> C-O-C." The water connection to the garage/studio structure must be shut off <br /> during the winter months.No portable or piped heating sources are allowed per <br /> Board of Health. <br /> 3. Prior to the issuance of an occupancy permit, there will be plantings installed; <br /> 6 ft. arborvitaes 6 ft. on center, starting from the end of the existing tree line on <br /> the bearing line north 40 feet, 48 degrees, 10 seconds east for a distance to the <br /> corner of the intersection of the bearing lot line 45 degrees west. <br /> 4.
