Town of Mashpee <br /> u 16 Gru at�lwl;1WC1 UN&111 <br /> hl asbpce Wassrachusats.02649. <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> V-2016-18 <br /> Leonard Mendes Bk#: 11660 <br /> 341 Great Neck Road North Page#: 197 <br /> (Map 60 Parcel 60-13-0-R) <br /> Mashpee,MA 02649 <br /> A Petition was filed on April 6, 2016 by Leonard Mendes requesting a Variance <br /> under §174-31 of the Zoning By-laws for relief from lot size requirements to deem lot <br /> buildable on property located in an R-5 Zoning District, (Map 60 Parcel 60-13-0-R), <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on April 15, 2016 and April 22, 2016 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 11, 2016 at which time the following members of the Board of Appeals <br /> sat in on this hearing; Vice Chairman, William.Blaisdell, Board Member, Scott Goldstein, <br /> and Associate Members, Brad Pittsley and Norman J. Gould. <br /> Mr.Blaisdell asked Mr. Mendes if he understood his choices to present his petition. <br /> Mr. Mendes said he would move forward with his petition. <br /> Mr. Mendes presented a plot plan that was hand-drawn by L. T. Hammond, dated <br /> September 11, 1953. It depicted three lots; Lot #2, Lot#3, and Lot#4. Mr. Mendes owns <br /> Lot#3. He said that both Lot #2 and Lot #4 were owned by different families and did not <br /> appear to be held in ownership together.He believes he can be granted relief by the Zoning <br /> requirement. <br /> Mr. Gould read an email from Tom Fudala, Town Planner dated May 5, 2016 into <br /> the record regarding Variances. It basically states that unless and applicant can meet all <br /> three (3) Variance criterion, than Variances should not be granted. <br /> Mr. Blaisdell read the Inspection Department comments dated May 4, 2016, and <br /> the Board of Health comments into the record. <br /> 1 <br />
