Town Of Mashpee <br /> 16 Great Neck Road North <br /> Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR ADMINISTRATIVE APPROVAL <br /> RELATED TO THE NEXT SUB-PHASE OF THE PROJECT <br /> AND THE 40B COMPREHENSIVE PERMIT <br /> Owner, Mashpee Commons Limited Partnership Subject: Administrative <br /> and Jobs Whiting Trust(JWT), Owner Acceptance of an ANR Plan <br /> Mashpee,MA 02649 dated September 11, 2023 <br /> endorsed by the Planning <br /> Board. <br /> On Wednesday, September 11, 2024, the Zoning Board of Appeals held a meeting with Mashpee <br /> Commons Limited Partnership (MCLP), and Jobs Whiting Trust (JWT), and JWT Phase 1B-D <br /> Venture, LLC (new single purpose entity that will be developing sub-phases 1B-11)), to discuss <br /> and accept an ANR(Approval Not Required)plan prepared by BSS Design and dated September <br /> 11,2023 that was endorsed by the Planning Board on October 18,2023 in accordance with Section <br /> IV: Decision and Conditions of the Comprehensive Permit, Condition#5 and Condition#34. <br /> Mr. Tom Feronti represented Mashpee Commons and provided the Board with the ANR plan. <br /> On behalf of Mashpee Commons, Mr. Feronti is requesting acceptance of the plan pursuant to <br /> Conditions 45 and#34 of the Comprehensive Permit.Condition#5 requires a discussion with the <br /> Board for a new subdivision of land that was part of the original acreage, and Condition #34 <br /> relates to a boundary conflict between Mashpee Commons land and the 40B Comprehensive <br /> Permit land. The plan prepared by BSS Design was endorsed by the Planning Board back in <br /> October 2023 and demonstrates the compliance for both of those conditions. <br /> The boundary correction for Condition#34 is dealt with through a land swap between Mashpee <br /> Commons Limited Partnership, and Mashpee Commons Il, LLC. There is an encroachment of <br /> the Mashpee Commons boundary line, and the land on the western edge of the original plan that <br /> consists of Lots 1A, 1B, and Lots 2 through 7. In order to correct this requires shifting the <br /> boundary lines consisting of 4,205 square feet of land through a land swap between Mashpee <br /> Commons land on the eastern edge and the 40B land. <br /> Mr. Feronti also discussed that Mass Housing is requesting approval of the subdivision of land <br /> to separate the East and West so that the financing agencies have the proper mortgage and <br /> collateral. The land swap of the subdivision of land on the East side encompasses Lot 25,and the <br /> West side are Lots 16E, 16F, 16A, and 20, 23, 22, and 27. <br /> 1 <br />
