TOWN OF MASHPEE
BOARD OF HEALTH
December 10, 1998
Meeting called to order at 7:00 p.m.
Members present: Robert F. Cram, Sr., Steven R. Ball and John T. Doherty
THE TAPE IS NOT PART OF THE MEETING IT IS FOR THE PURPOSE OF
TRANSCRIPTION ONLY.
Mr. Robert F. Cram, Sr., Chairman
1.) Warrants signed.
2.) Mr. Doherty motioned to accept the minutes of December 10, 1998, Mr. Cram
seconded, all agreed.
3.) Letter to D.E.P. re: Invoices - Continued until later in the meeting.
4.) Copy of letter from TIC re: Sewer_connection - Mr. McQuaid relayed, "This is
quite lengthy." "In my opinion, the Board should review this and request Mr. Fudala's
attendance at an upcoming meeting." "His request to Town Council, as far as the
Board's authority to adopt a regulation regarding requiring hookup to sewer if available,
is something that needs to be discussed along with our long range plans about the
nitrogen loading issue."
Mr. Cram stated, "My interpretation is that this proposal indicates that when a
regulation would promote the public health and safety or there is a health and safety
concern then the Board of Health could adopt a regulation." "Other than that we have no
authority to require all people in a given area to connect to a sewer or a treatment
facility_"
Board members agreed to request Mr. Fudala's attendance at an upcoming
meeting to discuss the matter.
5.) Variance request, 35 Santuit Lane - Mr. McQuaid relayed, "This is an existing
home with a voluntary upgrade due to the high water." "There are no plans to increase
the habitable space." "Significant variances are being requested." "They are proposing
dry wells and a pump chamber."
