3 <br /> <br />Board of Selectmen <br />Minutes <br />January 28, 2013 <br /> <br />OLD BUSINESS: <br /> <br />Assumption of Debt/Liability by the Town of Mashpee for Sewer System <br />Operational Matters: <br /> <br />Correspondence was received from Town Counsel Patrick Costello dated January <br />10, 2013 relative to the transfer of municipal sewer functions from the Town of <br />Mashpee to the Mashpee Water District pursuant to a Special Act anticipated to <br />be adopted by the General Court in 2013. <br /> <br />A critical issue is the assumption of potential debt and other contractual liabilities. <br />Town Counsel has recommended in his memorandum the Town of Mashpee <br />should refrain from incurring additional non-essential contractual obligations <br />relative to sewer matters at this time. <br /> <br />It was disclosed that a recent newspaper article indicated the Sewer Commission <br />is contemplating the implementation of long term sewer initiatives. <br /> <br />In response to Town Counsel’s memorandum, the Town Manager recommended <br />the Board adopt policy to not enter into any contract negotiations without <br />permission from the Board of Selectmen. Discussion followed regarding the <br />recommendation and matter of miscommunication. <br /> <br />Motion made by Selectman Cahalane that no further sewer contracts be <br />executed without the expressed concern of the Board of Selectmen. <br />Motion seconded by Selectman Taylor. <br />VOTE: Unanimous. 5-0. <br /> <br />Roll Call Vote: <br /> Selectman Richardson, yes Selectman Sherman, yes <br /> Selectman Taylor, yes Selectman Cahalane, yes <br /> Selectman O’Hara, yes Opposed, none <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
