CONSERVATION BOARD MEETING
August 13, 1980
Present:
Pauline F. DeLory, Vice Chairperson
Dorothy G. Studley
Wayne Tavares
The meeting was called to order promptly at 7:30 p.m.
Noticesof Intent filed by Bruce Fulton
Agent for E d E Realty Trust
Pauline: Read the Notice of Intent -- to construct a residence at 58 Heel Way, Jehu Pond,
Mashpee, in accordance with plans on file with the conservation commission. Also, to build
a house at 1? Tide Run, Jehu Pond, Mashpee, in accordance with plans on file.
Bruce Fulton: On both of these you will find that one is 40 feet from the street and the
other one is 42 feet from the street. I have brought the house as close to the street as I
can get it. All the septic systems are in the front toward the street. With the 40 feet,
you have 10 feet before you get to your tank and another 10 feet until you get to your other
tank and your other tank takes up 10 more feet and you have to be 10 feet from the road. So
the closest you can get to the road is 40 feet. On this particular one here (58 heel Way),
the front corner of the house just barely hits the conservation easement. There is a 50 ft.
conservation easement on this lot and I believe there is a 20 ft. on the other lot. I am
very far from the other one. This house here is 36 feet wide and it just squeaks in and I
just can't bring it in any closer no matter which way I do it. I am 15 feet from the side-
line, which is a requirement and 15 feet from the other sideline which is a requirement. I
.just barely make the conservation easement and I can 't bring it any closer to the road.
Wayne: And you have a reserve leaching area too.
Dorothy: Is that conservation easement marsh land?
Bruce: Shows where the conservation is and where the marsh land is. There is a good 20 ft.
of marsh on this property.
Dorothy: Is there a cellar proposed?
Bruce: There will be a cellar, yes.
Wayne: So you are going to bring in fill for this?
Bruce: You can see from this here that we don't hardly have to bring in any fill. This is
the topo right here and we are already at 10 feet.
Wayne: It is a nice high lot.
Bruce: Oh, yes. This here is 10 feet right here.
Pauline: It is still under the 11 feet so it is in the floodplain.
Bruce: Yes. The foundation is going to stick out 1 foot.
Dorothy: Can you do all your excavationfrom the rear portion of this so that you don't have
to extend on that easement at all?
Bruce: Yes. In fact, I will have to cart the dirt away.
