f �rr MASHPEE CONSERVATION C ESS C F LEGAL EEARING AND REGULAR MEETING DATE: April 11, 1979 Mashpee Town Hall. TIPIE: 7:30 11P.M. Mrs. DeLory opened the meeting, With the entire Commssion in attendance. The first thing oil the agenda was a discussion of the issuance of a Cease and Desist order on work being dome on the Sandler property. Apparently, Mrs. DeLory and Mrs* Sloane were out reviewing the Spit, with some people from DEQE and Camp., Dresser & McKee, and someone noticed some framing going on. Since itis on a salt marsh, it was suggested that the order be issued. The Order went out and Officer Dari issued it -� the compliance was dated February 2, 199 Lot 1090. 'opponesset Island Road. Mrs. DeLory said she spoke to the Chief the day she brought up the Cease and Desist Orden and he apologized because Marcia Du harme couldn I t find it in the file anywhere. Mrs. Studley said that it was on tap of the alarm box for a couple of weeks. She thinks Jim flames picked it up and asked if she wanted him to serge it and she told hien that somebody has got to. 'hether he took it and c oul.dn't serve or what she doesn 1 t know. Mrs. Studley said that Mrs. DeLory should get a police officer to go with her and see that it's served. Mrs. DeLory said that Mr. H nnigan called her this after- noon and said that he had gust gotten hack from Florida and would be in this evening to discuss the Sandler affair. A copy of the Cease and Desist notice was sent to Sandler. Harold Collins said Sandler was living at the Falmouth Condominiums and wouldn't accept it - it was returned. Mr. Hennigan arrived and said that to begin with, they ea2led it a salt marsh. He stated that it is not aF salt marsh, environmentallye He said there is no salt ,rater, it is in the grater seed area. - that lot has been there for 12 years registered land. - it has been sold three tees. He said that the Act is more -concerned with coastal dunes, coastal banes, etc. The area over there is a sheltered bay, not a coastal bark. He further said that the only problem he sees is the fact that they have pees of soil., supposedly of -like kind, and that soil is supposed to be compacted in 61, li ts, with an % moisture content,, what you see on the front, near the bank, does not belong there, adding that if that material was used to re�enf orce the bank, he could see a reason for a Cease and Desist Order, but the bank is not altered or changed.
