Studley; Vice Chairman <br /> Pauline F, e ory: Charles Buckinqhamo Warne Tavares, - Ia rch Da rdano and <br /> 'D Jean Thomas eazred to CAr s end of meeting <br /> Chairman Studley convened the meeting at 7: 35 p.m. <br /> rote of Commission - re: Issuing- Cease & Desist Orders <br /> Chairman Studley explained to the Commission that the Wetland Protection <br /> ".ct contains a provision where the Chairman of a Conservation Commission <br /> can issue Cease & Desist orders for the members of the Commission pro- <br /> viding that it is ratified at the following ricer ting. She said t7tat ' 'own <br /> Counsel seems to feel that the CoFumission should vote to permit the Chair-- <br /> man tc act for the Commission in issuing a Cease & 'Desist order in emer- <br /> gencies or in cases'ti� re a violation is observed and reported. All-ter some <br /> discussion on the subject, ayne Tavares pace a motion that the C jai rr an <br /> of the Conservation Commission be authorized to issue Cease & Desist or- <br /> ders. -larch ar rano seconded the motion. All . in favor, <br /> of scussion of Re-'I:-ainina Town Counsel - re: violation of Maushop Villa e <br /> Chairman Studley as%eco for a motion to retain town counsel in reference to <br /> the violations of maushop Village on which an Enforcement order wasdeliv- <br /> ered to the New "'4eabury Corporation. She said that no action has appar- <br /> ently been to eh to rectify the situation and the road has not been re- <br /> m'oved which they were directed to do. she said the area, to herknowledge, <br /> has not been restored to its natural state and has not been revetated. <br /> Charlie- Buckingham said that he was a little confused because the view that <br /> e has of the start of the road- *the cut going out toward the road, the <br /> extension going down to where -the. original Brod d area was used as access <br /> to the beach -- that it seems to hien that a good portion of that is beyond <br /> the 100 foot limit and ghat activity which has taken place beyond the 100 <br /> foot limit has in no war set up a situation where it is unfavorable im- <br /> pacted the area within the 100 Foot distance. <br /> Chairman Studley said that she is talking about the clamshell road which <br /> is within 140 feet of the coastal bank which has been constructed invio- <br /> lation of the order of conditions which is issued for -this project. She <br /> said that there was no road in the original plan. <br /> Charlie Euckingham said that it all comes back to the question of access <br /> to the beach in order ILI.--o provide for work upon the lower portion of the <br /> band to.-provide -access -for the beach nourishment supply program.
