•y <br /> MAS CONSERVATION COMMISSION <br /> MINUTES of FEBRUARY 8, 1996 <br /> Commissioners present: John Fitzsimmons, John Johansen, Daidd Shame, mph <br /> Shaw, Marry Desrosiers. <br /> The Chairman called the meeting to order at 6:55 p.m. <br /> i <br /> 6:55 PUBLIC CAIME1T: None. <br /> 7:15 JOEL E. Z G R for a Determination of ApplicabiW on a proposal to extend an <br /> existing deck and add stairs at 89 Popponesset wand Road. <br /> The Agent advised the deck will not extend further to the resource than existing and there <br /> is no encroachment into the 50 foot buffer zone. <br /> Public convents: none. <br /> VOTE: Motion made and seconded to find a negative deter nation. Unanimous Vote. <br /> NEGATIVE DETERMINATION. <br /> 7:20 OHN PIVD for a Det tion of Applicability on a 12 s.f extension into deck <br /> space and addition of a dormer at 16 Taff`rail Way. <br /> The Agent advised Michael UBIanc came in on this project which is a house on piers in <br /> the flood zone; they are going up and not increasing h ing space. This ming is only to <br /> insure that the number of bedrooms does not increase. <br /> Public comments: none. <br /> VOTE: Motion made and seconded to find a ne atiw detmninat io . Unanimous Vote. <br /> NEGA'T'IVE DETERMINATION. <br /> 7:25 ROBERT LUCKRAFT for a Detemiination. of Applicability on proposed <br /> rebuilding of e3dsting dock within the same footprint and to raise a portion of the dock <br /> from the saltmarsh at 33 Riverside Road. Jonathan Burtis presenting with l r. Luckraft. <br /> The Agent advised 1 Ir. Luckraft came through some yew ago and DEP had gi%vn no <br /> guidance. DEP decided the dock predated the Wetlands Act and, therefore, the <br /> commission had no authority. However, if there is any reconstruction, DEP stated they <br /> RD <br /> would have to go through the Commission with a Notice of Intent. He pointed out the <br /> Commission has been Aowing people to do this with the less costly RDA. He stated the <br /> dock is a hit lour and with no added expense it could be raised. <br />
