.a <br /> 22 August 1996 <br /> 'age 16 <br /> EXECUTIVE SESSION <br /> Transcripts of the last hearing for Alan Nash were distributed. <br /> Mr. Rosenberg read Mr. Nash's letter and suggested that his request be <br /> denied to reopen the issue. It has been fully discussed. Advise him that in <br /> accordance with usual procedures, the Commission w.ill preserve all tapes in <br /> their possession. <br /> Mr. Sherman suggested letting him remove that platform one-half way down <br /> and let him have the deck. <br /> Mr. Green suggested sending an enforcement order demanding he tear down <br /> the deck. <br /> Mr. Sherman stated the Order of Conditions ordered him to tear down the <br /> deck. Mr. Nasi stated he sexed Canton before and brought them to their <br /> knees. He said he has the money and where-with-all to do this. <br /> Aft. Green made a notion to send an enforcement order to Mr. Nash backing <br /> up the Order of Conditions with a cover letter. <br /> Mr. Rosenberg suggested as ars alternative write a letter that the Commission <br /> has considered his letter of August 20 and has decided there should be no <br /> change in the currently outstanding order. He is therefore advised that he <br /> should, within whatever time frame, comply with the requirements of the <br /> Order of Conditions in order to avoid an enforcement order which could carry <br /> fines in the amount of$300 per day. <br /> Aft. Fitzsimmons stated the amendment was denied and asked if the <br /> Commission owes hum anything. <br /> Mr. Sherman thought he wrote a good denial. <br /> Mr. Rosenberg stated this is the guy that was offered a half a loaf and he <br /> wanted the full loaf. At some point, the Commission is going to have to go to <br /> court, it is terrible and costs the town money but the Commission has an <br /> obligation, win or lose, it has to not be afraid. <br /> Mr. Johansen stated in the origiinearl hearing with Nash, it was brought up <br /> g <br /> about that deck and removing it. <br />
