1 lashpee Conservation Commission <br /> Minutes of April 2, 2009 <br /> Public Hearings i <br /> Mashpee Town Hall <br /> Present: vice Chairman Ralph Shaw, John Rogers, Jeff Cross, Mark Gurney, Lloyd Allen, Len Pinaud <br /> Also Present: Conservation Agent-Drew McManus, Assistant Conservation Agent-Liz Leidhold <br /> The'meeting was called to order with a quorum by vice Chairman Shaver at 6:55 pm. <br /> There was no public comment. <br /> Pre/Post Hearing Agenda <br /> l Approval of Minutes from March 5, 2009 <br /> Motion made, seconded and unanimously carried to Approve the Minutes of March 5, 2009 <br /> 2 Administrative Approval: SE 43-2430 <br /> The owner, John Copley of 85 Waterway, addressed the Commission regarding his request for ars <br /> outdoor shower to be installed on a pre-approved deck. The original Notice of Intent was for a <br /> septic system which was approved and completed. A second Notice ofIntent included a pool and <br /> overall landscape design for the right hand corner-of the parcel. The current request includes the <br /> addition of the shower to be attached to the exterior of the house, which will be connected to the <br /> septic. Agent McManus stated that the project was straightforward. <br /> Motion made, seconded and unanimously.carried to approve SE 43-24300 <br /> 3) 'ape & Islands Engineering Request to Change peavey Continuance Date <br /> Agent McManus reminded the Commissioners about the Reavey's approval for the After-the-Fact <br /> seasonal dock on John's Ponds. Turing installation of the seasonal dock, several freshwater <br /> mussels, a state listed species of special concern known as tidewater muckets, were crushed <br /> violating Natural Heritage and Endangered Species. A conservation management plan has been in <br /> the works and.finalized with Natural Heritage, resulting in .a fine being levied. The or'ginal <br /> continuance had been requested for June 11. Agent McManus has been in contact with Natural <br /> Heritage and IEP who both agree that the Commission can move forwaid on the hearing. Cape & <br /> Islands has requested that the hearing be moved up to April 16 at 7:21. Abutters will be re- <br /> ratified but no announcement is required in the paper since it is a continuance. Agent McManus <br /> has no concerns regarding the change in date. <br /> Motion made, seconded and unanimously carried to move the hearing to April 16 at +7:21. <br /> 4) Emergency Certification % <br /> Fire Chief George Baker and DPW Director Catherine Laurent requested that Agent McManus <br /> assess the Martin Road area as it enters the Quashnet River'woodlands and leads to an area where <br /> it passes over the riven. Four to 6 water bars will be installed on the road to prevent sheet flow run <br /> off into the river. In its current state, the roadway could cause hazardous driving over the water <br /> bars so some modifications will be made to allow for emergency vehicles. Gates will also b <br /> installed. work will be completed by the DPW in consultation with Waqoult Bay Additionally, <br /> Agent McManus noted erosion at the concrete structure at the end of Martin Road that would be <br /> accessed by emergency vehicles and recommended that rip rap stone be added.
