6 <br /> Mr. Ball asked if the BOH would require a deed restriction on this lot. <br /> Mr. Harrington replied that they had it already. It's on file because of the order <br /> for the treatment plant connection. The four-bedroom restriction already exists. <br /> Mr. Doherty stated that his only concern and it wasn't a big one is the location. <br /> He has no problem granting the variance for no reserve. However, how long is <br /> this treatment plant going to take to get on line and how many similar requests <br /> has the BOH seen and connections promised, but never materialized. <br /> Mr. Harrington responded that they are under State mandate to get this done. <br /> Mr. Ball made a motion to grant the variance (no reserve) requested by The <br /> Phoenix Group for 23 Shore Drive with no conditions. Mr. Santos seconded. <br /> Variance granted. <br /> 4. Variance Request: 266 Monomoscov Road <br /> Mr. Harrington stated that this has been postponed. The engineer, Ed Pesce, <br /> went to Los Angeles for a funeral. He requested that it be rescheduled for the <br /> November 1st, 2001, meeting. Mr. Harrington agreed. <br /> Mr. Harrington then asked if the BOH members wanted to know why they were <br /> going to be discussing this location. He continued by stating that there are a <br /> couple of variances that he needed to bring to the BOH's attention. One being <br /> the black water/gray water regulation that he believed was on the books that <br /> included a requirement to have 2' of natural occurring soil above the ground <br /> water table. This particular requirement is not present at that site, nor did the <br /> engineer prior to installation ever bring up this variance. This is going to be a <br /> mounded system. He wanted to make the BOH members aware that should <br /> this variance be granted others would also have to be allowed. The BOH <br /> members would be setting a precedent if it is granted or not if it is just by- <br /> passed. However, when the next person comes in saying this was never <br /> addressed there would be a continuation of the original issue. <br /> Mr. Ball interjected that we would have to let them have the same allowance. <br /> Ms. Warden stated that DEP also had questions that needed to be addressed. <br /> She didn't believe that the engineer had yet gotten back to the DEP. <br /> DISCUSSION <br /> A.
