28
Mr. Ball stated that he would make a motion to grant the applicant's request for a
three-bedroom with a denitrification system although he had his reservations. Mr.
Santos seconded this motion. Motion passed.
Mr. Harrington stated that a condition of the approval is to connect to town water
when it is becomes available.
Mr. Ball agreed with that condition. He believed that the well water was perfect in
that neighborhood. He really didn't have a problem with this because the well was
170' away and the BOH has granted down to 100'.
Mr. Harrington stated that it wasn't so much the well distance in this case as it
was the square footage of the property.
Mr. Santos asked if anything was across the street from the property.
Mr. Ball stated that Kenny Marsters was across the street.
Mr. Santos continued by asking if all of the wells were on the back of Bayshore
Drive.
Mr. Delorme confirmed the location of the wells. The well was set according to the
master plan.
Mr. Harrington reiterated that this would have to go to DEP for approval.
E. Mark Sullivan 121 Summersea Road
Mr. Sullivan was present as the owner of this address. He was previously approved
for a Fast System, which was no longer available. He would like the BOH to now
consider an approval for the recirculating sand system in its place.
Ms. Warden wanted the BOH to revisit the previous history of these two lots. This
was before the BOH when the original owner came in and wanted to combine the
two lots to sell them. However, even with the combination of the two lots he still
didn't have enough square footage because he was in a Zone II. He had to put in a
denitrification unit with approval from the state. This was under provisional use
due to the Zone II. He would only get credit for 550 gallons per day instead of the
660.
Mr. Harrington asked what the square footage of the property was.
Mr. Sullivan stated that it was 17,000 square feet.
Mr. Harrington continued that even with RSF it doesn't meet the nitrogen loading
regulations.
Mr. Ball stated that the BOH already approved it and all they are doing is
switching denitrification systems.
