23
issues, on the inspection report pertain to the regulation Section 410.750 with
letters next to them. Section 410.750 pertains to conditions that impair human
health and present a public safety hazard. They are conditions for
condemnation. He would like the BOH members to have a vote to request that
this property be condemned formally. He will then attempt, again to notify the
owner. The owner appears to be a trust of a trustee of a realty trust. He also has
what he believes to be the actual owner's address in Florida. He is going to send
everybody letters on this due to the fact that in a year's time the town will have
the right to take whatever steps it needs to mitigate the safety problems. He is
hoping that the owners will reappear once they find out that the dwelling is
going to be bulldozed. The dwelling itself is unsafe. The Town at some point to
could also step in and request to enter the property to clean it and place a lien
on it in order to mitigate some of the safety issues. The Town is going to
continue to spend time and money, which they need to document. Ultimately,
the costs to the Town should be placed in the lien against the property for some
recovery when the property is sold.
Mr. Santos suggested that the property be boarded up.
Mr. Harrington responded that the dwelling has been boarded up three times.
The kids go back and break another window.
Mr. Ball made a motion to formally condemn 7 Cranberry Avenue. Mr. Santos
seconded the motion. Motion passed.
B. 8 Regatta Drive
Ms. Warden began by stating that this is just a technical approval. The Cape
Cod Commission has already required that RSF on every single house in that
subdivision. It is a technical approval because it is a BOH regulation
requirement.
Mr. Ball asked whose subdivision it was.
Ms. Warden responded that it was a new one called "Quanset Village." Chris
Costa is doing all of the work.
Mr. Ball made a motion did a to approve the denitrification system along with an
O & M with quarterly monitoring for nitrogen for two years. Mr. Santos seconded
the motion. The motion passed.
OLD BUSINESS
EXECUTIVE SESSION
Being no further business, Mr. Santos motioned to adjourn this meeting at 9:56
PM.
Respectfully submitted,.
