6 She couldn't participate in the restaurant over the last two month. Again, in October her grandmother died in China. Her parents had go back for two months to handle the family affairs. As a result there was no one home to take care of the baby. Therefore, she had to stay home and wasn't participating at the restaurant either. Basically the two people who would have been more on top of things weren't there to be on top of things at the time most of the time. The new chef obviously came in October didn't work out at all and he is gone. They are not going to come here and rattle sabers stating that none of this happened or that none of these violations existed. But, basically they weren't on top of things. The situation with the family in China has resolved itself. The parents have come back. Cindy can be a lot more involved again. Mr. Chen's health has recovered in large part but not completely. He still can't lift anything. But, he can certainly be there on a daily basis a lot more than he was. So basically what they want to get across is just that this period had some very extenuating circumstances that explain why they would go from no violations to all of these violations. Mr. Doherty responded that by stating that he could appreciate the adversity. He understood that everyone encounters it at some time in our lives. However, prior to that period of adversity, there are three inspections with some of the same violations. He was very sorry to hear about Mr. Chen's bout in the hospital. But, the BOH is there to make sure that none of his customers wind up in the hospital. As far as the new chef, that excuse doesn't wash. It is the owner's responsibility to make sure that the chef is knowledgeable about Massachusetts CMR's regulations regarding food service establishments. You can try to abdicate that responsibility to an inexperienced chef just shows irresponsibility on the owner's part. As far as the death in the family, he was very sorry to hear about that. Mr. Santos joined the conversation at this time and stated that part of the stipulation the last time the BOH had a meeting with the Chens before on the previous violations. The BOH bent over backwards to suspend the fine in the agreement that there was going to be training of three employees. The question was asked, at that time, if there was going to be at least one person available of the three at all times. Now the Chens are saying that there is a new chef involved. The prior agreement was that they were going to go for the training so that there would be a "person in charge" with all of the necessary documentation. The Chens did follow through with that recommendation. One of the concerns of the BOH is that the Chens would train three people now. Then they would leave and somebody new would replace them. The Chens assured the BOH that one of those three people was going to be there at all times. Mr. Harrington interjected that there were two of the three people who had attended the ServSafe program were at the restaurant at the time of the inspection. Mr. Doherty stated that that fact is a little disturbing. You can't say that the knowledge wasn't there. You've had people now that have taken the course and passed it successfully. It is just a total disregard for the rules? A lot of times the BOH goes in and does an inspection. There are some violations. A week later it is all cleaned up. The BOH goes back in and re-inspect and everything is up to code, which would explain the August report. They had been in there two months beforehand. They are still on their toes and want to keep things clean because you know the BOH is coming back. Then they fall into a sense of complacency again and get back into old habits. The BOH walks
