§4-2. Organization. The Board of Selectmen shall reorganize at their first regular or <br /> special meeting following each annual election by the selection of a Chairman, Vice <br /> Chairman and Clerk, and notice thereof shall forthwith be given to the Town Clerk. <br /> History: Amended 8-25-1986 STM, approved by Attorney General 10-17-1986. <br /> §4-3. Powers and Duties. The executive powers of the Town shall be vested in the Board <br /> ol'Selectmen which shall be deemed to be the chief executive office of the Town. The <br /> Board of Selectmen shall have all of the executive powers it is possible for a Board of <br /> Selectmen to have and to exercise. The Board of Selectmen shall serve as the chief <br /> policy making agency of the Town. The Board of Selectmen shall be responsible for <br /> the formulation and promulgation of policy directives and guidelines to be followed <br /> by all Town agencies serving under it and, in conjunction with other elected Town <br /> officers and multiple member bodies to develop and promulgate policy guidelines <br /> designed to bring the operation of all Town agencies into harmony. Provided <br /> however, nothing in this section shall be construed to authorize any member of the <br /> Board of Selectmen nor a maiorityofsuch members to become involved in the day- <br /> to-dav administration ofany Town agency. It is the intention of this provision that the <br /> Board of Selectmen shall act only through the adoption of broad policv guidelines, <br /> which are to be implemented by officers and employees serving under it. [See <br /> Charter, Section 3-20). <br /> §44. Legal Proceedings. The Selectmen shall have full authority as agent of the Town to <br /> employ counsel to institute and prosecute suits in the name of the Town, except suits <br /> on bonds, notes or other securities given to the Town Treasurer, and to appear and <br /> defend suits brought against it and to appear in proceedings before any tribunal, <br /> unless it is otherwise specially ordered by vote of the Town. <br /> §4-5. Park Commissioners. The Board of Selectmen shall act as Park Commissioners for <br /> the Town and shall have authority to promulgate rules and regulations for use of <br /> Town-owned parks, playgrounds, beaches, athletic facilities or any other recreational <br /> facilities. No rules and regulations adopted shall conflict with this Code. The <br /> Selectmen shall have full authority under applicable provisions of law to establish, <br /> adopt and impose fines and/or penalties for any violations of a rule or regulation <br /> promulgated hereunder. Each violation shall constitute a separate offense on each <br /> successive occurrence.
