Ed stated a few months ago that they <br /> did not know these would overlap, but now suddenly in a review, we discover that it is a <br /> problem. Paul stated that Bill was going to go back and study the State funding and when <br /> does it trigger the start of the project. Phil stated that we did not get an answer to that <br /> because this larger issue came up. Phil stated that they called to ask that question and in <br /> the process this issue came up and essentially made that discussion moot and stalled the <br /> previous question. Ed stated that if there is a reimbursement law changes before the <br /> shovel goes in the ground, you get it. Paul understands that but asked when is it <br /> considered that the shovel goes in the ground; i.e. by signing the contract on phase 1 or <br /> phase 2. Ed stated that it would be the shovel starting the work. Phil stated that the DOE <br /> has said that starting work on the early site package is their consideration of starting the <br /> work. Paul stated that if you said okay, Jim, we do not want your $300,000 which doesn't <br /> trigger the project, which then puts us back to May 1, the issue is then, it would be nice to <br /> find out politically when DOE is going to vote on the $161 because the $161 may provide <br /> more funding than the $300,000. Phil stated that the DOE is not doing the voting, it is the <br /> Legislature. Paul stated that it was his understanding that once the DOE approves the <br /> submission o the $161, that everyone from that day on is eligible for that money and that <br /> the Legislature will vote for it, and when will it trip in. The Legislature might not vote for it <br /> until next May and it is from that committee meeting when they vote. Phil stated that they <br /> still need an answer to his original question which they do not have that night. Paul stated <br /> they just needed to know the technicality of when the project starts. Ed stated he did ask <br /> him that question and he said actual construction. He said that he could ask that in more <br /> ways and he thinks that by that definition you could get the additional reimbursement on the <br /> building but not the additional reimbursement sitework. Paul stated that as long as we can <br /> get it, he is wondering if they trigger off the project and they close it. Because if not, we can <br /> try to get somebody to find out from the DOE when are scheduling to vote on this thing. <br /> They have to do it pretty soon because they have to have all of their bills in to the <br /> Legislature by June 1. Ed stated that the request was in. Phil stated that the bill has been <br /> filed with the Legislature but it is a matter of when it comes up for a vote. It was Paul's <br /> understanding that once it came out of the DOE committee is when we are eligible for the <br /> money. Phil stated that no, DOE has made a recommendation to the Legislature to <br /> increase the funding to $161. That has been translated into a bill and the bill has been filed <br /> with the Legislature and where that bill is within the Legislative docket. Paul was wondering <br /> are we are eligible for the money when it comes out of the committee. Phil said no, when it <br /> is voted into law. <br /> • Fees Accounts SMMA/P&W and ACC: Ed stated that in he had the Off-Site Improvements. <br /> Paul stated that the last thing the attorney asked for was a detailed breakdown of that cost. <br /> Steve stated that the turning lanes and such are not part of your requirement. Ed stated <br /> that they have spent every contingency that every existed on this contract so that the Scope <br /> of Services has to start at the site limit lines. Paul asked Ed to go back to his sub-contractor <br /> and ask him to break it out. Phil said this was in the context of the earlier discussion to <br /> expanding it to include what Greg was talking out. Paul asked in order to get this resolved <br /> one time, to go back and ask to get a fee for phase 1 and phase 2, the entire project, with <br /> breakdown of scope and then it would be a done deal. In conversation Paul had with <br /> Council this week, he seems to be very willing to not take just one side. He seemed to be <br /> trying to find every area which would have some reasonability of it and that is why he said to <br /> let him see the detailed breakdown and maybe then he could put more judgment light on it. <br /> Phil said they would get that right away. <br /> • Early Site Package Surveying Services: Tom stated the surveying services were to be done <br /> by BSS. He said that at the last meeting, the Committee had asked for clarification on the <br />
