ti <br /> 4 <br /> MASHPEE HIGH SCHOOL BUILDING COMMITTEE <br /> MONDAY , APRIL 24 , 1995 <br /> TOWN HALL <br /> Present: Joe Polito, Steve Greelish , Bill Martiros , Merry Sue Ahlgren , <br /> Paul Griffin , Peter Dinizio <br /> Also Present: Ian Aitchison , Tom Wren , Joel Seeley <br /> Meeting convened at 4 : 12 p . m. <br /> Everyone welcomed Bill Martiros back . <br /> The Committee will vote on the minutes next week , because they just <br /> received them today . <br /> Because there were many people in the audience, Paul asked them to <br /> introduce themselves and the firms they represent . <br /> Paul first explained to the Committee what had transpired this past week <br /> and suggested then they listen to the comments of the visitors. <br /> Paul explained that the low bidder, Stone , asked for a 10 day waiver to <br /> meet their minority participation requirements . As of today , they have met <br /> those requirements . <br /> Town Counsel sees no legal objection to awarding this contract to Stone . <br /> The Town has received 2 protests: <br /> - from Eastern Contractors (second lowest bid) , are protesting the 10 day <br /> waiver. <br /> - TLT has an objection to the first 2 low bids, but Paul does not <br /> understand their point, because that would not make them low bidder. They <br /> are the low bidder only if the Committee were to take only the first 2 <br /> alternates . <br /> The Committee has recommended taking all 10 alternates. <br /> Paul explained that Eastern chose Argat (masonry) for an extra $250 ,000 . <br /> Had they not carried them , Eastern would be low bidder. They did it to <br /> meet their minority requirements . <br /> Town Counsel has said whatever they filed , that is it. <br /> On the form it clearly stated , regarding the minority requirement: <br /> - you could submit all the information up front. <br /> - request a permanent waiver. <br /> - request a 10 day extension . <br /> It was up to each bidder how they would meet this minority requirement. <br /> It is a home rule form, generated by the Town of Mashpee. <br /> It is up to this Committee and to the Selectmen to decide if they accept <br /> Stone ' s request for a 10 day extension . If it is accepted , the next step <br /> is clear. If it is not accepted , then the Town must disallow their bid. <br /> Paul has discussed this in great detail with Town Counsel . Mashpee gave <br /> the provision for the waiver , it would be unfair not to accept it. If you <br /> don ' t accept it , Mashpee should eliminate it from the form. <br /> 1 <br />
