where the problems come from.
Paul said her firm was not the low bid (for masonry) , they came in much
higher and that is why the other contractor (Stone) did not carry her. You
didn ' t win the game. 1.
Ms . Donohue said Mashpee is going to wish she won the game when they see
what they end up with as a final product.
Dave Packer from Stone said they feel they have complied with the documents
and feel they followed the rules and regulations.
Frank Marino from Eastern said when they prepared their bid , they added up
all the numbers and came to this price, using WBE/MBE business , as the bid
required.
By allowing the waiver, you allowed the low bidder to work the formula
backwards, it is not a level playing surface. They can go back (after
submitting their bid) , make changes and put things together. Eastern was
not afforded that opportunity .
Paul said that is not true, Eastern could have elected to do that.
j Mr . Marino said it was their decision to do the right thing . You put a
fork in the road .
Paul said he has heard most of these comments already , during the week .
j These people have talked, through Bob Whritenour and letters on these
issues.
He said the situation still stands, Eastern carried a higher minority sub
bid . All the general contractor 's bids said they received all the addenda.
Merry Sue asked if it is the Committee ' s legal obligation to take the low
bidder?
Paul said yes , unless there is a reason , clear information , to move on to
another one.
Joe said that every bidder had the chance to select the 10 day waiver.
I,I Peter said after the addenda was issued , some firms revised their bids and
some went forward with their original submission and that was the firm' s
decision . They had the opportunity to change but they were not flexible
enough to deal with the reality of the situation .
Ian asked if this question was raised a the pre-bid conference?
Joel said the 10 day extension was asked for at the pre-bid meeting . As a
result, Town Counsel developed the form and then inserted the 10 day waiver
as an addenda.
** Joe made a motion to accept all 10 alternates . Merry Sue seconded
the motion . All members were in favor 6-0. ** .
** Paul made a motion the Committee recommend to the Selectmen they
accept Stone Building Company ' s waiver for a 10 day extension of
MBE/WBE participation . Merry Sue seconded the motion . All members
were in favor 6-0 . **
3
