SECTION IV <br /> RECORDS,SPECIAL EDUCATION, LAWS, RETENTION <br /> Special Education Services <br /> The district provides programs that support special education of students along a continuum of <br /> services. On the basis of eligibility services include language based learning centers, behavior <br /> support centers, autism spectrum resources, and related services.The district also offers a range of <br /> related services such as, occupational therapy, physical therapy, counseling, and speech/language <br /> services for those who qualify. <br /> The Individuals with Disabilities Education Act(IDEA) <br /> The Individuals with Disabilities Education Act(IDEA) is a United States federal law whose <br /> purpose is to guarantee equal education opportunity for all school-age children requiring special <br /> education. The law provides for the referral to an Evaluation Team of any student who is unable to <br /> progress effectively in a general education program. <br /> In addition to parents/guardians, the Team can be comprised of a nurse, school counselor, school <br /> adjustment counselor, psychologist, special and regular education teachers, occupational, physical, <br /> and speech therapist. Administrators may also be include in Team meetings as well. <br /> The Team convenes to review the evaluation of the student to determine eligibility for services and <br /> develop an educational plan which is responsive to the child's individual special needs. <br /> School Notice of Non-Discrimination <br /> No person shall be excluded from or discriminated against in their application for admission to a <br /> public school of any town, or in obtaining the advantages, privileges and courses of study of such <br /> public school on account of race,color, gender, religion, national origin or sexual orientation. <br /> Summary of Regulations Pertaining to Student Records <br /> The State Board of Education has adopted Regulations Pertaining to Records. The development of <br /> these regulations, which have the force of law, was mandated by state laws enacted in 1972 and <br /> 1974. The regulations apply to all public elementary and secondary schools. They are designed to <br /> ensure parent/guardian and student rights of confidentiality, inspection, amendments, and description <br /> of responsibilities for the maintenance of student records. <br /> Note: Access to student records pursuant to General Law, Chapter 71, Section 340, shall be given to <br /> all parents/guardians and students of a certain age, upon request via the child's guidance counselor. <br /> Interpretation of said records will be provided with appropriate notice. <br /> A student's record must be made available to the student and/or his or her parent(s) or guardian <br /> within two consecutive weekdays after an initial request to the principal of the school. <br /> By decision of the Mashpee School Committee, copies of the records shall be furnished upon <br /> request, for a fee of$.20 per page. This rate is equivalent to the cost of reproduction. A <br /> professionally qualified staff person shall be available, upon request, to interpret any of the contents <br /> of the record. In addition, the eligible student and/or his or her parent/guardian may have the student <br /> record inspected or interpreted by a third party of their choice upon due written consent of the <br /> eligible student or parent/guardian. <br /> 33 <br />
