P.C. <br /> David Patrick, President <br /> The Stone Building Company <br /> Page 2 <br /> September 1, 1995 <br /> Furthermore, the Standard Form of Agreement between owner <br /> and contractor, Article 3.2, requires that the outdoor softball, <br /> baseball, soccer and multipurpose fields under base bid, and <br /> Alternate 10 work, are to be substantially complete within 120 <br /> days. It is my understanding that this work must be <br /> substantially completed on or before September 6, 1995. i am <br /> told that it is highly unlikely that substantial completion will <br /> be achieved with respect to this work by that date. Please be <br /> advised that the Town of Mashpee intends to enforce any and all <br /> remedies, including the assessment of liquidated damages, <br /> available to it on account of late completion of project work. <br /> It is quite disconcerting to Town officials that the subject <br /> project has already encountered serious scheduling problems and <br /> delays in the completion of critical items of work. As you know, <br /> many critical aspects of the project work must be completed prior <br /> to the onset of winter conditions. At the current rate of <br /> progress, there will undoubtedly be far more significant progress <br /> issues encountered over the next several months. Please be <br /> advised that the Town considers this to be a matter of utmost <br /> concern and consequence. School projects, by their very nature, <br /> must be completed in strict accord with the project schedule <br /> provided at the commencement of the work. I urge you to take <br /> whatever steps are necessary to avoid continued lagging in the <br /> approved project schedule for the Mashpee High School. <br /> I trust that these issues will be addressed promptly and <br /> that appropriate measures will be taken by The Stone Building <br /> Company to bring this project back on schedule. The Town hereby <br /> requests a response from you on or before Friday, September 8, <br /> 1995 addressing the progress and scheduling issues outlined <br /> herein. <br /> ery ruly y 6i`-�1 <br /> Patrick J.
