10) When using any basket rake or approved harvesting tool, all natural cull material must be removed and returned to the waters from which it was taken,preferably below the mean low water mark. All man-made debris such as bottles, cans, glass, etc. must be removed from the area and disposed of in a proper place and manner. At no time should any cull materials be placed above the high water mark on public or private property. 11) All holes made by dry-digging shellfish shall be filled in and seed replanted before moving to another area, 12) The harvesting of shellfish by any means or methods other than those approved by the Board of Selectmen is prohibited. Shellfish may be taken by hand, short-handled clam rake, hand trowel, (garden variety), spade fork, plunger, dip net, scratcher or "potato rake", basket rake or bull rake, or scallop drags (see the scallop regulations for drag restrictions). Mechanical or hydraulic harvesting tools or methods, or use of approved harvesting tools from a vessel under power or sail is prohibited unless allowed under a special permit or regulation issued by the Board of Selectmen. 13) The harvesting of eels,oysters, and scallops are subject to separate and/or additional regulations as set forth in Article 5 of these regulations. 14) Digging or plunging shellfish within two feet of the edge of a marsh structure is prohibited. Digging or displacing marsh grass is prohibited. 15) Scuba diving for the purpose of taking shellfish is prohibited. Snorkeling or skin diving for shellfish is allowed in all approved swimming areas of the Town of Mashpee. (Skin divers are subject to Mashpee ByLaws, Article 4.7, Section 4.7.5.1). 16) All shellfish predators such as starfish,whelks and their eggcases, and cockles should be removed from the water and deposited above the high water mark in an appropriate receptacle such as a public trash barrel at a town landing, or removed and deposited at the town dump. 17) All shellfish shall be brought ashore in the shell. ARTICLE N. COMMERCIAL SHELLFISH REGULATIONS Commercial shellfish permit holders are subject to all regulations set forth in Article III as well as the following: 1) Commercial shellfishing is prohibited on Sundays. 2) No commercial permit holder shall harvest shellfish from areas designated as "Family Permit Only"except for species allowed under such designation as where stipulated otherwise in any other section of these regulations. (See scallop,oysters regs.) 3) A commercial permit holder may also hold a Mashpee Non-Commercial Family Shellfishing Permit. However he/she may only fish that permit on Sundays. Other members of a commercial shellfisherman's family are not subject to this restriction. 4) No commercial shellfish permit holder shall employ or otherwise be assisted by another individual in the act of taking, harvesting or culling shellfish unless that person is also a licensed Mashpee Commercial Shellfisherman, unless stated otherwise in these regulations. ARTICLE V. SPECIAL PERMITS. SEASONS. REGULATIONS 1) Eel Regulations - the waters of the Town of Mashpee are closed to the taking of eels by any means other than a single hook and line or by spearing. The use of eel pots or multi-hook rigs is prohibited until further notice. 2) Oyster Regulations-the harvesting of oysters is prohibited until further notice. 3) Scallop Regulations- to be submitted at a later date. 4) Shellfish Grant Regulations-to be submitted at a later date. ) !
