(4) That the Department may allow vehicle access to designated <br /> service roads for the sole purpose of access to fishing <br /> areas to persons over sixty years of age, those suffering <br /> from ambulatory disabilities, or holding disabled veteran <br /> status . Said access shall be by permit only, restricted <br /> to a maximum of six vehicles at any one time, and such 1a <br /> travel shall be allowed only between the hours of sunset <br /> and sunrise. Such vehicles shall be limited to designated <br /> ways and shall in no circumstances be driven off the <br /> designated route onto sand or other unimproved terrain or <br /> R used for overnight stays. Any violations of the permit <br /> provisions shall, upon finding of violation by the South <br /> Cape Advisory Committee, cause the revocation of said <br /> permits. In the event the above provisions are deemed dis- <br /> criminatory under the law, such use of vehicles shall be <br /> prohibited altogether. In no event, and under no circumstances <br /> shall there ever be an increase in said vehicle use above <br /> the 6 maximum herein provided for. <br /> (5) That parking shall be limited to several landscaped sites , i <br /> with a total maximum capacity of no more than 400 vehicles. + <br /> Buses will be allowed by permit only. Such parking areas i <br /> shall be finished with a permeable or semi-permeable material <br /> acceptable to the South Cape Beach Advisory Committee. The <br /> parking area shall be, if at all feasible, on land purchased <br /> in fee by the Department. Failing the reaching of agreement <br /> for such negotiated purchase, the Department will exercise ]' <br /> rights available for taking by eminent domain. In any event ''! <br /> and however acquired the Department will promptly initiate l <br /> and expeditiously support legislation which will authorize <br /> the Department to deed, subject to conservation and other <br /> restrictions contained herein, said land to the Town of Mashpee '14: <br /> for a nominal consideration of one dollar; and the Town, <br /> covenants, in turn, that it shall promptly execute a renewable <br /> lease to the Department for a period of 99 years for a nominal <br /> consideration of one dollar, said land, which lease shall <br /> contain a right to re-entry for breach of any one of the <br /> covenants and conditions contained herein. It is expressly <br /> covenanted and agreed that no other land within the park other <br /> than that specifically designated and identified in accordance i <br /> with these provisions will be used as a parking area or for <br /> purposes of public parking. <br /> (6) All Town owned land acquired by the Department will be <br /> acquired by Deed of the Town conveying the subject land <br /> in fee simple. <br /> (7) Any land in private ownership purchased by the Department for <br /> parking purposes shall be subject to a restriction limiting <br /> use to the Department to 400 cars; and all the other conditions ; <br /> contained in this Agreement. j <br /> -2- <br /> G <br />
