Section 11B: Water Resource District <br /> 1. Purpose <br /> The Purpose of the Water Resource -District is to protect the <br /> public health by preventing contamination of the ground and <br /> surface water resources providing water supply for the Town <br /> of Mashpee. <br /> 2. Creation <br /> A Water Resource District is hereby created covering areas <br /> described on maps titled "Water Resource Districts". Such <br /> Water Resource District shall be considered to be super- <br /> imposed over any other zoning districts established in the <br /> zoning by-laws . Land in a Water Aesource District shall be <br /> subject to the following restriccions, in addition to those <br /> of the underlying district. <br /> 3. Definitions <br /> For the purpose of this by-law, the following will define <br /> terms used within: <br /> 3.1 "Process Wastewater" shall include all. wastewaters <br /> disposed 'on site other than sanitary wastewater. <br /> 3. 2 "Recharge Area" shall mean the area encompassing land <br /> and water surfaces through which precipitation enters <br /> the groundwater body, and from which groundwater flows <br /> naturally, or is drawn by pumping, into the water supply <br /> well . <br /> 3. 3 "Toxic or Hazardous Materials" Any substance or mixture <br /> of such physical , chemical or infectious characteristics <br /> as to pose a significant actual or potential hazard to <br /> water supplies , or other hazard to human health, is such <br /> substance or mixture were discharged to land or waters <br /> of this town. Toxic or hazardous materials include, <br /> without limitation, organic chemical petroleum products , <br /> heavy metals , radio-active or infectious wastes , acids <br /> and alkalies , and include products such as pesticides , <br /> herbicides , solvents and thinners . Wastes generated <br /> by the following activities , without limitation, are <br /> presumed to be toxic or hazardous, unless and except to <br /> the extent that anyone engaging in such an activity can <br /> demonstrate the contrary to the satisfaction of the Board <br /> of Health: <br /> _1- <br />
