Article 51 (continued) <br /> increased requirements such lot was held in ownership separate from <br /> that of adjoining land and such lot has an area of at least five <br /> thousand square feet and fifty feet of frontage. <br /> indefinitely postpones <br /> 9:30 P.M. motion carries <br /> Article 52. <br /> To see if the Town will vote to amend Section 6.3.1.9 of the Zoning By-Law <br /> by deleting therefrom the second and third sentence, and by adding a new Section <br /> 6.3. 1 . 10 as follows: <br /> "A special permit shall be required for all fixed or floating piers, <br /> wharfs or docks, both seasonal and year-round. Prior to the grant of <br /> any such special permit, the Board of Appeals shall request the advice <br /> and recommendations of the Conservation Commission and the Harbormaster, <br /> and shall not grant the special permit if the structure will unduly <br /> interfere with free passage of travel by water or cause substantial <br /> disruption of the marine environment. Any special permit granted <br /> hereunder shall be subject to the securing of all necessary permits <br /> from Town, State and Federal Government units having jurisdiction <br /> over inland and or coastal waterways and wetlands. <br /> and by the designation SP under the R1 , R2, R3, R4, R5, and C2 columns. <br /> indefinitely postponed . . . .no hearing <br /> 9:32 P.M. motion carries <br /> Article 53. <br /> To see if the Town will vote to amend Section 9.321 of the Zoning By-Law <br /> by deleting the words "three (3)" wherever appearing and substituting therefore <br /> the words "two (2)" <br /> accept as printed with deletion o£"or take any other action related <br /> thereto" <br /> 9:35 P.M. unanimous vote <br /> Article 54. <br /> To see if the Town will vote to amend the Mashpee Zoning By-Laws by adding <br /> thereto the following new Section 11C and by amending the zoning map to show <br /> ACEC area in conformity with the map dated November 26, 1979, "Waquolt Bay, Areas <br /> of Critical Environmental Concern," which is on file in the Town Clerk's office <br /> or take any other action relative thereto. <br /> IIC. AREAS OF CRITICAL ENVIRONMENTAL CONCERN (ACEC) <br /> 1 . PURPOSE. The purpose of this by-law is to protect areas of <br /> Critical Environmental Concern, to protect environmental values <br /> of significance to flood control , the prevention of storm <br /> damage, the protection of waters containing shellfish and <br /> fisheries, and other public interests protected by the <br /> Wetlands Protection Act (M.G.L. , Chapter 131) and the Town's <br /> Wetlands Protection By-Laws. <br />
