Article 8 <br /> To see if the Town will authorize and direct the Board of Selectmen to file a Home Rule petition <br /> with the General Court in substantiany the followf rig form: <br /> 'Be it enacted the Senate and House of Representatives in General <br /> Court assembled, and by the authority of the same, as follows: <br /> SECTION 1. Notwithstanding the provisions of any general or special law to the contrmY, the <br /> Mashpee Water District may, by vote at a special or annual district meeting called within one <br /> hundred twenty days of the effective date of this act, provide for the levy of special assessments to <br /> recover the whole or part of the cost incurred by the Town of Mashpee and assumed by the <br /> Mashpee Water District for laying pipes in the Tri-Town Circle/Horseshoe Bend Way area of <br /> ibution of water to inhabitants of said area, in accordance with <br /> Mashpee for the conveyance or distn I of Chapter Forty <br /> the provisions of Section Forty-Two G, Section Forty-Two H and Forty-Two <br /> of the General Laws. <br /> -ary, the <br /> SECTION 2. Notwithstatiding the provisions of any general or special law to the conti <br /> Town of Mashpee, by vote at a town meeting, may provide for the payment to Cape Harbor <br /> Development Corporation of the sum not to execeed$152,250.80 as reimbursement for the cost of <br /> construction of a municipal well and testing on land owned by the Town and to use for this <br /> purpose all or any part of the debt authorized pursuant to the unanimous vote approving Article 24 <br /> of the July 27, 19 87 Mashpee Special Town Meeting as subsequently approved by ballot question <br /> 16 of the Masbpee special election of July 28A 1987. <br /> SECTION 3. Notwithstanding the provisions of any general or special law to the ccntr�ary, the <br /> Town of Mashpee is authorized to pay to the Mashpee Water District a sum of money to remediate <br /> the ground water contamination in the Ashers'Path(Summerwood areas and to use for thLs purpose <br /> all or any part of the debt authorized pursuant to the unanimous vote approving Article 24 of the <br /> July 27, 1987 Mashpee Special Town Meeting as subsequently approved by ballot question 16 of <br /> the Mashpee special election of July 28, 1987. <br /> SECTION 4. For such periods as the Board of Water Commissioners may request, the Assessors <br /> of the Town of Mashpee shall be the District Assessors. During such periods, the Town <br /> Assessors shall receive such salary for their services as District Assessors as shall be agreed upon <br /> by the Board of Water Commissioners and the Town Selectmen. All district a&sessments shall be <br /> committed to the Distnct Tax Collector,who shall collect said tax in the manner provided by law <br /> for the collection of Town taxes and who shall deposit the proceeds thereof with the District <br /> Treasurer for the use and benefit of said district For such periods as the Board of Water <br /> Commissioners may request, the Town Tax Collector shall be the District Tax Collector. During <br /> such periods, the Town Tax Collector shall receive such salary for services as District Tax <br /> Collector as shall be agreed upon by the Board of Water Commissioners and the Town Selectmen. <br /> Nothing contained herein shall be construed to limit the authority of the District to hire its own <br /> Assessors or Tax Collector and to pay for same from the District's revenues.
