To see- if the Town will vote to amend the Town, By-Laws by adding thereto a <br /> new Section 4.5.1 .c. as follows� <br /> Section 4.5.1 .c. <br /> c. Any person who is the owner, keeper, or individual haying responsibility for a dog <br /> -shall Insure that such a dog is not a nuisance by reason of excessive howling o.r <br /> barking between the hours of 10:00 p.m. and 8:00 a.m. <br /> For the purpose of this By-Law nuisance shall be defined as "a source of <br /> annoyance to sicv or convaiescing j <br /> persons residing in the vicinity and disturbing a <br /> person or persons reasonable right to peace or privacy by rnaking !oud or <br /> continuous noice bybarking orhowling,which is plainlyaudible off ofthe piemi3es," <br /> 'Whoever vioiates the provisions of this By-Law shall upor, a first offense in a <br /> calendar year be issueda ve-lbalwarning, upon any subsequen't 'violation within said <br /> calendar year wil; be assessed a fine of Fifty($50.00) Dollars. <br /> Motion to accept as read. . . . . . .MOTION CARRIES. . . . . . . . . .8:25 P.M. <br /> Article 75 <br /> To see it the Town will 'vote to amend Article 4.8 of the Town By-Laws by <br /> deleting Section 4.8.7 and adding the following new sections: <br /> 'Section 4.8.7 Mlotor Vehicle Stickers- It shall be unlawful for any person to trans- <br /> fAr to ano!her venicle, forge or alter a motor vehicle sticker issued <br /> bythe Town of Mashpee for Town services orto be in possession of <br /> a stickerwhich has been unlawfully transferred,forged oraftered. <br /> Section 4.8.8 Enforcement- The foregoing By-Law may be enforced bythe Police <br /> Department, all other la�w-enforcement officers, the Park and <br /> Recreation Department personnel authorized and designated by <br /> the Director in writing. <br /> Section 4.8.9 Penalties - Any person violating any of the foregoing provisions of <br /> Article 4.8 shall be punished by a fine of $50-00 for each offense. <br /> The provisions of Massachusetts General Laws Chapter 40, Sec- <br /> tion 21 D, providing for non-criminal disposition ;f violations of this <br /> By,�Law shall be applicable and the person taking cognizance of any <br /> 'Violation, as an alternative to crh-ninal proceedings, may give the <br /> offender a written notice as provided for in said Section 21 D. <br /> Mozion to acceD- as read. . . . . . . . .;rGT_­N ,'AiJTE <br /> . . . . . . . . . . .8:25 P.M. <br />
