e <br /> Motion carries. . . . . . . . . . . . . .9:26 p.m. <br /> e <br /> Article 22 <br /> To see if the Town will vote to amend Section 150-6.A of the Town of <br /> Mashpee Code by deleting the current language of said section and substituting <br /> the following: <br /> "Before the Town shall vote to accept any private way as a public way upon <br /> private petition, there shall have been filed with the Board of Selectmen a <br /> petition for acceptance, a plan of the way proposed for such acceptance, and <br />` releases from any and all damage claims resulting from the laying out, grading <br /> and construction of the way and the taking by eminent domain of any land <br /> necessary to lay out the way in such form as required by the Board of <br /> Selectmen. Such a petition for acceptance of a private way as a public way <br /> must contain the signatures of at least fifty percent ( 504x) of the owners of <br /> the land abutting said way; provided however, that in a situation where two or <br /> more contiguous private ways are proposed for acceptance under one petition, <br /> it shall be sufficient if the petition contains the signatures of at least <br /> fifty percent (504x) , in the aggregate, of all of the owners of the land <br /> abutting the contiguous ways. " <br /> Submitted by DPW Director <br /> Motion: Article 22 be voted as printed in the warrant. <br /> Motion carries. . . . . . . . . . . . . . . . 9:29 p.m. <br /> Article 23 <br /> To see if the Town will vote to authorize and empower the Board of <br /> Selectmen to prepare a plan laying out and defining Conaumet Highlands <br /> Subdivision consisting of Silver Leaf Lane, Cypress Circle, Candlewood Lane, <br /> Southwind Circle, Balfour Lane, and a portion of Fox Hill Road; and to <br /> accomplish said purpose and for expenses incidental and related thereto, the <br /> Town vote to raise and appropriate or transfer from available funds for <br /> appropriation a sum of money to the Conaumet Highlands Subdivision Roadways <br /> Account and to raise said appropriation the Treasurer with the approval of the <br /> Board of Selectmen be authorized to borrow at one time, or from time to time, <br /> a sum of money under and pursuant to Chapter 44, Section 7 or 8 or any other <br /> enabling authority and to issue bonds and notes of the Town therefore, and <br /> further, to see if the Town will vote to raise and appropriate or transfer <br /> from available funds a sum of money to the Conaumet Highlands Roadways Account <br /> to provide interest and debt issuance expenses. <br /> Submitted by Petition <br /> Motion: Mr. Baker, non-resident, be allowed to make the motion for Article 23. <br /> Motion carries. . . . . . . . . . . . . . . 9:30 p.m. <br /> Motion: The Town vote to authorize and empower the Board of Selectmen to <br />
