To see if the Town will vote to amend the Zoning Bylaw by amending <br /> Subsection 174-24 C. ( 6) to change the phrase "not less than forty-five (45) <br /> days "in the first sentence tc. read "not less than twenty-one ( 21 ) days. " <br /> Submitted by Town Planner <br /> Explanation: The Zoning Bylaw currently provides that public hearings for <br /> special permits must be held within 65 days , but not less than 45 days, after <br /> the filing of an application. The intent of the 45-day period was to allow <br /> time for other boards and interested parties to review projects before the <br /> I ` public hearing. However , the waiting period has proven to be an unneccessary <br /> burden for the proponents of many smaller projects reviewed by the Board of <br /> Appeals. As a result, this article seeks to reduce the minimum pre-hearing <br /> review period to a more reasonable 21 days. For larger projects , the Zoning <br /> " Board of Appeals and Planning Board would still have the option of setting a <br /> longer pre-hearing review period on a case by case basis. <br /> This article was approved as Article 8 of the October 5 , 1992 Annual Town <br /> Meeting but rejected by the Attorney General due to a flaw in the advertising <br /> of the Planning Board' s public hearing. <br /> v Recommendation: The Planning Board recommends approval . <br /> Motion: Motion Article 8 be voted as printed in warrant. <br /> Motion carries by unanimous voice vote 9 : 16 P.M. <br /> {� Article 9 : <br /> To see if the Town will vote to amend the Zoning Bylaw by adding the <br /> phrase "or permits for those persons described in Subsection ( 4) (a) below" <br /> after the phrase "from provisions of this section" in the third sentence of <br /> j Section 174-26.D. ( 3) . <br /> F <br /> Submitted by Board of Selectmen <br /> Explanation: Building permits for projects covered by our Growth Management <br /> bylaw must be applied for between the first and the fifteenth of the month and <br /> may only be issued after the fifteenth. This procedure was established <br /> because the bylaw sets an order of priority in which the monthly limit on <br /> building permits may be issued. This article would allow those persons who <br /> are listed by the bylaw as highest priority, individual lot owners who are <br /> building a home for their own residence and have not received another building <br /> permit in the previous two years, to apply for and receive building permits at <br />`s any time of the month. <br /> This article was approved as Article 9 of the October 5, 1992 Annual Town <br /> Meeting but rejected by the Attorney General due to a flaw in the advertising <br /> of the Planning Board' s public hearing. <br /> Reccomendation: The Planning Board recommends approval . <br />
