G. "Slow,No Wake"-A slow speed at which a watercraft can still be controlled,yet produce <br /> no wake. Approximately 6 miles per hour. See Headway Speed. <br /> H. "Watercraft"-Any vessel or object used to navigate the waterways. Includes but is not limited <br /> to,a motor boat,row boat,jet boat,sail boat,dinghy,inflatable boat or personal watercraft. <br /> 1. "Waterways"-any body of water upon which watercraft can be used. <br /> In this bylaw, the definitions as found in MGL Chapter 90, §1 Definitions, as published and as may be <br /> amended,shall have the same meaning. <br /> §170-2. Promulgation of Regulations; Posting of Signs. <br /> A. The Harbormaster shall'promulgate regulations to implement the provisions of this chapter. <br /> B. The Harbormaster, Assistant Harbormasters, or Waterways Assistants shall see that speed, water- <br /> skiing, and personal watercraft regulations are posted at public landings on waterways within the <br /> town. Further signs and markers may be placed at strategic locations throughout the waterways. <br /> §170-3. Enforcement;Violations and Penalties. <br /> A. Unless otherwise specified,the provisions of this chapter as well as Chapter 90B shall be enforced <br /> by the Harbormaster and Assistant Harbormasters, and by police officers empowered to patrol the <br /> waters of the Town of Mashpee. <br /> B. Whoever violates any of the provisions of this chapter and refused to obey the lawful and <br /> reasonable orders of those empowered to enforce same or resists them in the discharge of their <br /> duties shall be fined according to the fine schedule set forth in regulations promulgated by the <br /> Harbormaster and approved by the Board of Selectmen pursuant to Section 170-2 (A) of this <br /> chapter. (Mashpee Waterways Regulations, Mashpee Mooring Regulations and Mashpee Pond <br /> Ramp Regulations). Violation of this chapter may be enforced by non-criminal disposition <br /> pursuant to MGL Chapter 40 Section 21(D). <br /> §1704. Speed. <br /> A. Maximum Speed for watercraft is"Slow,No Wake"(Headway Speed): <br /> 1. during the period from one (1) hour after sunset to one(1) hour before sunrise, in any area of <br /> any fresh water waterway. <br /> 2. in posted areas <br /> 3. within one hundred fifty(150)feet of <br /> (a) shore <br /> (b) bathers(also see Swim area) <br /> (c) vessels propelled by means other than machinery <br /> (d) vessels not underway(for example moored or anchored) <br /> (e) commercial docking or mooring areas ' <br /> (f) private docking or mooring areas <br /> I <br /> 4. On the following bodies of tidal water. <br /> (a) Great River,except in any planing channel as may be posted in Upper Great River <br /> (b) Little River <br /> (c) Santuit River <br /> (d) Mashpee River <br /> (e) Ockway Bay,except in any planing channel as may be posted <br /> (f) In the Mashpee part of Shoestring Bay and Simons Narrows <br /> 5.
