II. By revising the fourth and fifth sentences of Section 174-55C to read as follows: <br /> Such signs may not exceed forty (40) square feet in signboard area and may not be closer than five <br /> (5)feet to any lot line or block a line of sight for pedestrian and traffic safety if so determined by the <br /> D.P.W. Director. The top edge of any such freestanding shall be not higher than fifteen (15) feet <br /> vertical measure above the average level of the ground between the supports of each sign. <br /> Explanation: The first change is being made for reasons previously discussed. The lowering of signs from <br /> 25 to 15 feet is suggested because otherwise freestanding signs in commercial zones would be at height that <br /> approaches that of the building height in C zones. <br /> N. Section 174-55D currently reads: Advertising signs or other devices of any kind advertising products or <br /> services for sale shall not be permitted to be affixed to the outside or inside windows of any structure so as <br /> to be visible from outside of the structure, except that such signs or devices advertising seasonal products <br /> or sale items may be permitted,but in no event shall more than ten percent 10%of the area of the window <br /> be covered by said sign or device. <br /> I. Also by deleting Section 174-55D and replacing it with the following: <br /> Sign coverage of a window shall not exceed 25% of the total window size.A window sign shall be any <br /> sign,picture,symbol,or combination thereof that is placed inside a window or affixed to the window <br /> pane or glass and is intentionally visible from the exterior of the window. No sign shall be affixed to <br /> the outside of window. <br /> Explanation: This section,as currently written,is a situation where an attempt is being made to regulate the <br /> "copy" of signs and has been found to be unconstitutional. Therefore it is being rewritten so that a <br /> reasonable amount of window signage can be provided. <br /> O. Section 174-55E currently reads: No freestanding sign shall have signboard area(or display area if no <br /> signboard) exceeding the dimensions allowed under Subsection C above, measured from the tops of the <br /> topmost display elements, and including in such measurements any blank space between display elements. <br /> No display or signboard dimensions shall exceed forty(40)feet for a freestanding sign. <br /> I. By revising Section 174-55E to read as follows: <br /> No sign shall have signboard area(or display area if no signboard)exceeding the dimensions allowed, <br /> and included in any such area measurements is any space between display elements. <br /> Explanation: Changes are being proposed in order to reduce redundancy to the sign article and make it <br /> clearer to read,as Section 174-55C outlines the size requirements. <br /> P. Section 174-55F currently reads: Illuminated signs are permitted subject to the following conditions: <br /> (1) No sign shall be intermittently illuminated,internally illuminated nor of a traveling light, animated <br /> or flashing light type. No exposed neon-type signs shall be permitted in the Town of Mashpee. <br /> (2) Sign illumination is permitted only between the hours of 7:00 a.m. and 11:00 p.m., except that the <br /> signs of commercial or industrial establishments may be illuminated during any hours that these <br /> establishments are open to the public or in operation. Illuminated signs on public buildings and land <br /> are exempt from this provision. <br /> I. By revising Section 174-55F(1)to read as follows: <br /> (1) No sign shall be intermittently illuminated, nor of a traveling light, animated or flashing light <br /> type.. No internally lit signs shall be allowed, except as provided in subsections (2)(b), (c) and (d) <br /> below. <br /> Explanation: As proposed limited use of internal illuminated signs will be provided for, per requirements <br /> outlined in changes to Section 174-55F(2). The deletion of the neon sign clause is to provide for limited <br /> neon sign use as outlined in Section 174-55F(2). <br /> 11. By moving the text of existing Section 174-55F(2) to Section 174-55F(3) and replacing Section 174- <br /> 55F(2)with the following: <br /> (2) Signs shall be illuminated in the following manner: <br /> a)externally illuminated. <br />
