i <br /> Town and the Massachusetts Department of Environmental Management ("DEM") as "all <br /> municipally owned lands within the proposed boundaries of the [South Cape Beach State] Park," <br /> including the existing town beach and a portion of Great Oak Road and other parcels within said <br /> Park, being the land shown on Assessor's Map 130, Block 6, to the Selectmen for the purpose of <br /> conveyance to the Commonwealth of Massachusetts pursuant to the option held by the Town <br /> under the agreement entitled "South Cape Beach Development Agreement" between the Town <br /> and DEM dated December 27, 1990, on such terms and conditions as the Board of Selectmen <br /> may determine, which may include restrictions on the future use of said land. <br /> Submitted by the Board of Selectmen <br /> Explanation: This Article carries out the intent established in the previous Article to exercise <br /> the Town's option negotiated with the Commonwealth of Massachusetts as part of the "South <br /> Cape Beach Development Agreement". through this Article the actual transfer of title is <br /> approved to transfer the Town's South Cape Beach to the State and to accept ownership and <br /> control of the State's new South Cape State Beach. <br /> Motion made by Morris Kirsner. <br /> Motion: I move the Town vote to transfer the care, custody, management, and control of the <br /> land described in Article 31 to the Selectmen for conveyance to the Commonwealth of <br /> Massachusetts as printed in the warrant except for the phrase "or take any other action relating <br /> thereto". <br /> Move to indefinitely postpone passes at 8:45 p.m. <br /> Article 32. <br /> To see if the Town will vote to authorize and empower the Board of Selectmen to prepare a plan <br /> laying out and defining Algonquin Avenue and to accomplish said purpose and for expenses <br /> incidental and related thereto, the Town vote to raise and appropriate or transfer from available <br /> funds for appropriation the sum of$5,000 to the Algonquin Avenue Account and to raise said <br /> appropriation the Treasurer with the approval of the Board of Selectmen be authorized to borrow <br /> at one time, or from time to time, the sum of$5,000 under and pursuant to Chapter 44, Section 7 <br /> or 8 or any other enabling authority and to issue bonds and notes of the Town therefore, and <br /> further, to see if the Town will vote to raise and appropriate or transfer from available funds a <br /> sum of money to the Algonquin Avenue Account to provide interest and debt issuance expenses. <br /> Submitted by the Board of Selectmen <br /> Explanation: This Article is placed on the warrant by the recommendation of the Department of <br /> Public Works and the approval of the Board of Selectmen as provided for under Mashpee Code <br /> 150-7. <br /> I <br /> Recommendation: Finance Committee recommends approval. <br /> Recommendation: Planning Board recommends approval. <br />
