i <br /> Motion passes at 9:49 p.m. <br /> Article 41. <br /> To see if the Town will vote to authorize the Board of Selectmen to lease, or transfer fee title to, <br /> a portion of that Town-owned parcel of land shown on the 1996 Mashpee Assessors Maps as <br /> Map 61, Block 3, to the Mashpee Water District, on terms satisfactory to the Board, with said <br /> portion to consist of two acres, more or less, fronting on Ashers Path, approximately as shown <br /> on a map entitled "Proposed Land Transfer to Mashpee Water District" which is on file in the <br /> office of the Town Clerk as an attachment to this warrant article; and further, vote that such land <br /> shall not be held as conservation land pursuant to the provisions of section 5-27 of the Town By- <br /> Laws; and further, vote that the Board of Selectmen be authorized to submit a petition to the <br /> General Court to allow said lease notwithstanding any provisions of the General Laws to the <br /> contrary; and finally, vote to authorize the Board of Selectmen to enter into agreements and <br /> execute any and all instruments as may be necessary on behalf of the Town to effectuate such <br /> lease or transfer. <br /> Submitted by the Board of Selectmen <br /> Explanation: This article would authorize the Board of Selectmen to lease or sell to the <br /> Mashpee Water District approximately two acres of land on Ashers Path adjacent to the Transfer <br /> Station for the purpose of constructing a Water District office and maintenance facility. <br /> Motion made by Selectman Marsters. <br /> I <br /> Motion I move the Town vote, pursuant to Section 5-27 of the Town By-lawis, that the portion <br /> of the Town-owned land shown on the 1996 Mashpee Assessors' Map 61 as Block 3, and more <br /> particularly shown on a map entitled "Proposed Land Transfer to Mashpee Water District" <br /> which is on file in the office of the Town Clerk, not be held as conservation land; to transfer to <br /> the Board of Selectmen for the purpose of selling to the Mashpee Water District the care, <br /> custody, management, and control of said land; to authorize the Board of Selectmen to convey <br /> said land to the Mashpee Water District; to authorize the Board of Selectmen to submit a petition <br /> to the General Court, if necessary, to authorize said sale; and to authorize the Board of <br /> Selectmen to enter into agreements and execute any and all instruments as may be necessary on <br /> behalf of the Town to effectuate such conveyance. <br /> Motion defeated at 10:02 p.m. <br /> Article 42. <br /> To see if the Town will vote to adopt the following resolution, a copy of which will be presented <br /> to the U.S. Secretary of Interior: <br /> WHEREAS the people of the Town of Mashpee have respect for the natural <br /> process and the role of all species in Cape Cod's natural habitat. <br /> THEREFORE we hereby petition the United States Fish and Wildlife Service to <br /> abandon the gull extermination program that was implemented in 1996 and is scheduled ' <br />
