i <br /> connection with the financing thereof; and that (vi) the Board of Selectmen and <br /> all other Town boards are each authorized to execute any and all instruments as <br /> may be necessary on behalf of the Town to complete the acquisition of the land <br /> described in this vote. <br /> Motion to amend made by Francis LeBaron. <br /> Article 21 Amendment Motion <br /> Motion: I move that (i) the Board of Selectmen be and hereby is authorized to <br /> acquire by purchase or otherwise, for active recreation, conservation, passive <br /> recreation and/or other municipal purposes, all or a portion of a certain parcel of <br /> land known as the "Belcher" or "Mingo" property, bounded generally by Great <br /> Neck Road North, Ashers Path, Lowell Road, the Quashnet Valley Country Club, <br /> Phinney's Road and William Mingo Road and shown on the 1998 Mashpee <br /> Assesors' Maps as Map 44, Blocks 45, 46 and 58 through 84, inclusive, Map 51, <br /> Block 3 and Map 52, Blocks 40 through 60, inclusive, and more particularly <br /> described as Parcels 1, 2 and 3 on a plan entitled "Topographic Plan of Land in <br /> Mashpee, Massachusetts for Belcher Realty Trust" dated January 5, 1998, revised <br /> January 12, 1998, by Baxter&.Nye, Inc. a copy of which is on file in the office of <br /> the Town Clerk; (ii) the sum of$2,300,000 is hereby appropriated to pay the costs <br /> of acquiring the aforementioned land and for the payment of all other expenses <br /> incidental and related thereto, and that to meet this appropriation, the Town <br /> Treasurer, with the approval of the Board of Selectmen, is hereby authorized to <br /> borrow said sum under and pursuant to Chapter 44, Section 7 of the <br /> Massachusetts General Laws, or any other enabling authority, and to issue bonds <br /> or notes of the Town therefor; (iii) that the Board of Selectmen and all other <br /> Town boards are hereby authorized to apply for and accept federal and/or state <br /> grants for the purposes stated in this vote, including reimbursement under Chapter <br /> 132A, Sectionl l of the Massachusetts General Laws, the "Self-Help Act" and/or <br /> Chapter 933 of the Acts of 1977, as amended, the "Urban Self-Help Act", and any <br /> other such enabling authority; (iv) the Board of Selectmen is hereby authorized to <br /> enter into contracts or agreements with federal and/or state agencies and other <br /> public or private entities or persons in connection with the purchase of the land <br /> described in this vote; (v) the Board of Selectmen is hereby authorized to petition <br /> the General Court for any legislation necessary or convenient for the acquisition <br /> of the land described in this vote or in connection with the financing thereof; (vi) <br /> the Board of Selectmen and all other Town boards are each authorized to execute <br /> any and all instruments as may be necessary on behalf of the Town to complete <br /> the acquisition of the land described in this vote. Provided, however, that this <br /> appropriation shall be contingent upon a vote at an election to exempt from the <br /> provisions of G.L.C. 59 § 21C (Proposition 2 ''/z), the amounts required to pay the <br /> principal of and interest on the borrowing authorized under this vote. <br /> Finance Committee does not recommend approval of amendment. <br /> Motion to amend passes 202 to 114 at 9:15pm. <br /> Motion made to extend Town Meeting to 11:00pm defeated at 9:59pm. <br />
