' I <br /> Amended Article 35 Version 1 <br /> Planning Board &Clerk Changes Without Overlay District Change <br /> To see if the Town will vote to amend the zoning bylaw by adding the following new <br /> sections and subsections: <br /> Add the following to the listing of zoning districts contained in Section 174-4: <br /> "Wireless Facility Overlay District". <br /> Add the following new Subsection C. to Section 174-5 Establishment of Zoning Map: <br /> T.The Wireless Facility Overlay District shall include 1) the area within the 210 foot <br /> wide Commonwealth Electric Company transmission line easement running generally <br /> east-west between the Falmouth town line and the Barnstable town line, 2) all other <br /> lands in the Town which are not located within the boundaries of the Mashpee <br /> National Wildlife Refuge, within 1000 feet of the mean high water line of a Great <br /> Pond or a tidal water body, within Historic Districts, within 1000 feet of a Historic <br /> District or of structures or places listed in the Massachusetts State Register of <br /> Historic Places, within the Otis A.N.G.B. Accident Prevention Zone or within 300 feet <br /> of the right of way of any designated scenic roadway." <br /> Add the following new Subsection H.W(9) to Section 174-25. Table of Use <br /> Regulations: <br /> "(6)(9) Personal wireless service facilities, subject to the provisions of Section 174- <br /> 45.2." <br /> i <br /> and indicate by inserting the letters "SP" in all columns of the Table of Use Regulations <br /> that such use is allowed by special permit in all zoning districts. <br /> Add the following new Section 174-45. 3: <br /> "174-45.3-3. Personal Wireless Service Facilities. <br /> A. Purpose and intent. <br /> For the purpose of minimizing the visual and environmental impacts, as well as any <br /> potential deleterious impact on property values, of personal wireless service facilities, <br /> no personal wireless service facility shall be placed, constructed or modified within <br /> the town except in conformance with the requirements of this section, in conjunction <br /> with other regulations adopted by the Town, including historic district regulations, <br /> design review and other bylaws and regulations designed to encourage appropriate <br /> land use, environmental protection, and provision of adequate infrastructure <br /> development. <br /> The regulation of personal wireless service facilities is consistent with the purposes <br /> of the Mashpee zoning bylaw and the planning efforts of the town through its <br />
