October 4, 1999 <br /> Annual Town Meeting <br /> Article 29 <br /> To see if the Town will vote to amend the zoning bylaw as follows: <br /> Add the phrase"Mashpee Center Overlay District"to the listing of zoning districts contained in Section <br /> 174-4; <br /> Add the following new Subsection 174-5.D.: <br /> "D. The Mashpee Center Overlay District shall include those parcels shown on the 1998 Mashpee <br /> Assessors' Maps as Map 27, Block 46, Map 28, Blocks 3 through 12, Map 35, Blocks 30 and 31, and <br /> Map 36,Blocks 1 through 20,5A,5B,41 through 45,47 and 49 through 52." <br /> Add the following new Subsection 174-24.I.: <br /> "I. Notwithstanding the uses specified in the Section 174-25 Table of Use Regulations or the <br /> provisions of any other section of this Chapter, the following uses are prohibited within the Mashpee <br /> Center Overlay District: <br /> (1) Parking facilities located at the front of any lot facing Main Street (Route 130) or <br /> Great Neck Road North. Parking shall only be allowed to the side or rear of the <br /> principal structure on such lots. <br /> (2) Those uses specified in Subsections 174-25.D.(5), E.(7), E.(8), F.(1), F.(2), F.(6) and <br /> F.(7). <br /> (3) Any drive-in or drive-through window or similar facility associated with a restaurant <br /> or any other business establishment." <br /> Add a reference to footnote 20 in the heading of the "Front" column under "Minimum Building <br /> Setback to Lot Lines" in the Section 174-31 Land Space Requirements Table ani idd the following <br /> new footnote 20 to the footnotes to said Table: <br /> "20 Minimum front building setback within the Mashpee Center Overlay District shall be 20 <br /> feet and maximum allowed building setback for the principal structure on a lot shall be 40 <br /> feet." <br /> or take any other action relating thereto. <br /> Submitted by Planning Board and <br /> Historic District Study Committee <br /> Explanation: This article would prohibit certain uses in the vicinity of the traditional town center near <br /> the intersection of Route 130 and Great Neck Road North which are incompatible with the historic <br /> character of the area, including radio and television transmission facilities, veterinary establishments <br /> and kennels,lumber yards, building supply yards and similar retail stores where merchandise is stored <br /> in the open,gasoline service stations,sale or rental of automobiles,boats or other motor vehicles,drive- <br /> in banks,drive-in eating places and other consumer service establishments where the motorist does not <br /> have to leave his car or where food is normally consumed outside the building and any drive-in or <br /> drive-through window or similar facility.
