October 4, 1999 Annual Town Meeting Article 32 - To see if the Town will vote to amend the zoning bylaw by amending Section 174-21.1 as follows: delete the phrase"(except for one-family dwellings on individual lots in existence on May 3, 1999 and their accessory structures)"in subsection A, replace the phrase "lots occupied, or proposed to be occupied, by" in subsection B.(1) with the word "new", replace the phrase"For lots occupied or proposed to be occupied by other uses" in the first sentence of subsection B.(2)with the phrase"For new subdivision roadways or for lots occupied or proposed to be occupied by uses other than single or two-family homes", insert the phrase "Except when there are no other feasible alternatives" at the beginning of the third sentence of subsection B.(2), replace the sixth sentence of subsection B.(2) with the following: "Infiltration systems shall be located so that no part of any leaching system is located less than one hundred(100) feet from drinking water wells.", replace the word"structure"in the last sentence of subsection B.(2)with the phrase"leaching system", replace the term "permitting authority" with the term "building inspector" in the first sentence of subsection C and insert the following between the words}`demonstrate the"and"operation and effectiveness"in the first sentence of subsection C.:"location and nature of proposed stormwater facilities for development under subsection B.(1) and shall require their implementation. For development under subsection B.(2), the permitting authority shall require the submission of sufficient plans and specifications to demonstrate the location,nature" or take any other action relating thereto. Submitted by Planning Board Explanation: This article proposes minor changes to the stormwater management article submitted by petition and approved at the May, 1999 Town Meeting. The Planning Board believes that these changes will clarify the intent and simplify the administration of that bylaw. Motion made to dispense with reading of Article. Motion to dispense with reading of Article passes at 10:30 P.M. Motion made by Selectman Taylor. Motion: I move Article 32 be approved as printed in the warrant with the exception of the phrase, "or take any other action relating thereto."
