October 4f 1999 <br /> Article 16 <br /> ores and bedrock. <br /> RECHARGE AREA - Any area of porous, permeable geologic deposits, especially but not exclusively <br /> deposits of stratifies] sand and gravel through which water from any source drains into an aquifer, and <br /> includes any wetland or body of surface water surrounded by or adjacent to such area, together with the <br /> watershed and any wetland or body of surface water adjacent to such area. <br /> SOLID WASTES - Useless, unwanted or discarded solid materials with insufficient liquid content to be free <br /> flowing, including, for.example, rubbish, garbage, scrap materials, junk, refuse, inert 1111 material and <br /> landscape refuse. <br /> §174-79. Delineation of district. <br /> A. General provisions. <br /> (1) For the purposes of this Article, there is hereby established within the Town of(Mashpee an overlay <br /> district consisting of certain groundwater protection areas, including aquifers and recharge areas, <br /> which are delineated on a map dated January 1988 entitled"Groundwater Protection District,Town of <br /> Mashpee," and which shall be considered as superimposed over other districts established by the <br /> zoning bylaws of this town. This map, as it Illay be amended frons time to time, is on file with the <br /> office of the Town Clerk, and, with any explanatory material thereon, is hereby made a part of this <br /> chapter. <br /> (2) Uses otherwise not permitted in the portions of a zoning district superimposed by this district shall not <br /> be pernlittcd in this district. <br /> (3) Where the bounds of the Groundwater Protection District, as delineated on the Groundwater <br /> Protection District Map, are in doubt or in dispute,the burden of proof shall be upon the owner(s), the <br /> town may engage a professional hydrogeologist or soil scientist to determine more accurately the <br /> location and extent of an aquifer or recharge area and may charge the owner(s) for all or part of the <br /> cost of the investigation. <br /> (4) The Groundwater Protection District shall include all of the land within the lines describe([ ill <br /> Subsection 13(1) through 13(5). <br /> B. Bounds. <br /> (l) including all of the land within the following described lines: <br /> n shore line of' Ashunlct Pond intersects the <br /> Beginning at the point where the souther <br /> Mashpee/l�alnlouth Town line; <br /> Thence southeasterly and easterly along the Mashpee/Falmouth Town line to the westerly side line of <br /> FallllOutll Road(Route 28); <br /> Thence northerly and westerly by the eastern property line of the 1987 Mashpee Associations' Map <br /> 87, Plots 4 and 5, Map 88, Plot 40 and Map 81, Plot I to the southerly line of the New Bedford Gas <br /> and Electric Light Company easement where it intersects the western property line of Map 81,Plot 6; <br /> Thence westerly 1,567 feet,more or less,to.thc easterly side line of existing Whitings Road; <br /> "Thence northerly by the easterly side line of existing whitings Road to its intersection with the south <br /> side line of the Nathan S. Ellis Ilighway(Route 151); <br /> 86 <br />
